JUDGMENT Ashwani Kumar Singh, J. Heard learned counsel for the petitioner and learned State counsel. 2. This petition under Section 407 Cr.P.C. has been moved by the petitioner Teerath Ram, who is complainant in criminal case no. 1641 of 2014(State versus Prithraj), case crime no. 534 of 2013 under Sections 420, 467, 468 I.P.C., police station Kaiserganj, district Bahraich for transferring the bail application of opposite party no. 2 Prithraj, which is still pending in the court of District and Sessions Judge, Bahraich, to another court of Additional District and Sessions Judge, Bahraich. 3. Contention of learned counsel for the petitioner is that learned court of District and Sessions Judge, Bahriach is not considering the submission of learned counsel for the petitioner/ complainant. 4. There is provision in Cr.P.C. for appearance of the private counsel to oppose bail application and without abiding by the procedure laid down in law, the private counsel has no locus standi to appear. There are other allegation also which need not to be mentioned since they are vague. 5. Considering the submission of learned counsel for either parties, I do not find it to be a fit case to transfer the bail application from the court of District and Sessions Judge, Bahraich to another court of Additional District and Sessions Judge, Bahraich. Accordingly, the petition is dismissed.
