On the above said report, FIR No. 267/2013 u/s 143, 341, 323, 447, 452, 379 and 427 IPC was registered and investigation commenced. The matter is still under investigation. 4. Mr. Babu Lal, ASI, PS Lalsot, District Dausa is present in person and submitted factual report of the matter through Mr. NS Dhakad, learned Public Prosecutor which is taken on record. As per factual report offence u/s 143, 323, 325, 427 and 447 IPC is made out against the present petitioner along with co-accused Prithviraj Gurjar, Kamal Gurjar, Ramhet Gurjar, Raju Gurjar, Birju Gurjar, Ramesh Gurjar, Suraj @ Dhandu Meena, Bharat Lal, Raghuraj Gurjar for which charge-sheet No. 143/2014 has already been registered. Since, accused persons have failed to submit their bail bonds, therefore, charge sheet could not be filed in the court. 5. Learned counsel for the petitioner submits that previously two investigating officers investigated this matter but they did not find involvement of present petitioner in the alleged offences. Now, the present investigating officer without any additional material wants to file charge sheet against the present petitioner, therefore, investigation may be transferred to CID (CB) for fair and impartial investigation. 6. Per contra, learned Public Prosecutor and learned counsel for the respondent no. 4 submits that previous investigating officer also found involvement of present petitioner and the investigation was transferred on the complaint of accused persons. Therefore, it cannot be said that there is any doubt in fair and impartial investigation. He submits that this misc. petition may be dismissed. 7. I have considered the submissions made by the learned counsel for the petitioner and learned Public Prosecutor and learned counsel for the respondent no. 4. 8. Since, after investigation investigating officer reached on the conclusion that aforesaid offences are made out against the present petitioner along with other co-accused and charge sheet has already been registered, therefore, no question of transferring the investigation arises. Therefore, this misc. petition being devoid of merit is hereby dismissed.Petition dismissed. *******
