JUDGMENT : Prakash Gupta, J. 1. By this criminal appeal filed under Section 374 Cr.P.C. the appellant seeks to challenge the judgment of conviction and order of sentence dated 24th April, 2010, passed by the learned Additional Sessions Judge (Fast Track) No.2, Jhunjhunu in Sessions Case No.72/2007 (113/2007), whereby the appellant has been convicted for offence under Section 302 IPC and sentenced to life imprisonment and to pay a fine of Rs.5000/-and in default thereof, to further undergo six months' simple imprisonment. 2. The facts of the case as summarised are that Gajendra Singh (PW.9) on 24th April, 2007 submitted written report (Ex.P.12) to the Station House Incharge, Police Station Bisau mentioning therein that the previous evening Dheer Singh, his cousin, told him that Mahaveer S/o Goru Ram Chamar, Raju Daroga and Shishpal S/o Jamnadhar Daroga had killed his goat and when he complained about the same they threatened to kill him. He further mentioned that he had assured him that he would call them and talk to them. On the morning of 24, April 2007 Vishnukant Mehrishi told that somebody had killed Dheer Singh, whose body was lying near the Rani Sati Temple. He reached the place of occurrence and found the dead body of Dheer Singh. Then he gave information at the police station. Report was submitted for necessary action. 3. On the basis of this written report, the police registered formal FIR No.37/2007 (Ex.P.13) for offence under Section 302 IPC against unknown person and investigation commenced. Inquest report (Ex.P.5) of the dead body was prepared. Site plan (Ex.P.6) of the place of occurrence was also prepared. Blood stained soil was recovered vide recovery memo (Ex.P.7). Controlled soil was recovered vide recovery memo (Ex.P.8). From the place of occurrence two broken teeth of the deceased Dheer Singh were also recovered vide recovery memo (Ex.P.9) and personal belongings of the deceased i.e. a tea shirt, pant and used pair of shoes were recovered vide recovery memo (Ex.P.10) and (Ex.P.11) respectively. The dead body was subjected to post mortem and the post mortem report is (Ex.P.1). Statements of the witnesses were recorded under Section 161 Cr.P.C. and on the basis of the statements of the witnesses accused appellant Devi Singh was arrested vide arrest memo (Ex.P.39).

During custody accused Devi Singh furnished an information under Section 27 of the Evidence Act which was reduced in writing vide (Ex.P.41) and on the basis of the information furnished by the accused one bamboo stick was recovered vide (Ex.P.15). Similarly, on the basis of the information furnished by the accused under Section 27 of the Evidence Act, pant and shirt of the accused were recovered vide (Ex.P.16). After completion of investigation challan was filed against the appellant for offences under Sections 302 and 201 IPC. Upon committal, the learned trial court framed charges under Sections 302 and 201 IPC against the accused appellant to which he denied, pleaded not guilty and claimed trial. 4. To prove its case, the prosecution examined as many as 24 witnesses and exhibited 45 documents. On completion of trial, statement of the accused appellant under Section 313 Cr.P.C. was recorded wherein he stated that neither his pant, shirt nor lathi was recovered at his instance. In the night intervening 23 and 24 April, 2007 blood came from his nose which was found on his clothes. He neither met Dheer Singh nor called him to his house. He is not guilty and has falsely been implicated in the case. However, in defence no witness was examined. 5. The learned trial court on conclusion of trial acquitted the appellant of the charge under Section 201 IPC but placing reliance on the evidence of (PW.14) Surya Prakash, (PW.15) Dinesh Kumar, (PW.20) Karan Pal Singh, (PW.21) Sampat Singh, (PW.22) Mahipal Singh and (PW.23) Sada Kanwar convicted and sentenced the appellant as mentioned hereinabove vide judgment of conviction and order of sentence dated 24th April, 2007. 6. Learned counsel appearing for the appellant has contended that in a case based on circumstantial evidence, the prosecution should prove a complete chain of evidence and each and every piece of incriminating circumstance must be clearly established by cogent, reliable and clinching evidence and the circumstances should be such which leaves no other hypothesis other than the guilt of the accused. It is submitted that the findings of the learned trial Court are perverse and based on wrong assumptions of fact and law. In the FIR (Ex.P.12) nothing has been mentioned about the last seen circumstance, as falsely deposed by the Smt. Sada Kanwar (PW.23). On the one hand Sampat Singh (PW.21) stated that he was the eye witness of the occurrence whereas Sunil Kumar (PW.24) gave an entirely different version. According to him no witness had seen the incident. Smt. Sada Kanwar (PW.23) has stated that she requested Sampat Singh (PW.21) to find out the whereabouts of the deceased and the accused. However, this fact has also been not mentioned in the FIR. It has also been argued that the Hon'ble Apex Court has been pleased to order in a catena of decisions that last seen evidence is a very weak type of evidence and conviction of the accused cannot be based on this type of circumstantial evidence. Further, case material sent to the FSL was also not sent in a sealed condition so, there is absence of link evidence. Furthermore the recovery of the articles has also not been proved by the prosecution. The place where from the alleged recovery has been shown is easily accessible to public and the accused did not have exclusive possession of the place of recovery. Murad (PW.11) is a motbir witness but he has turned hostile. Therefore, the prosecution has not been able to prove the recovery memo (Ex.P.15) and (Ex.P.16). In the Malkhana Register (Ex.P.40) there is no entry in respect of the lathi and clothes being sent to the F.S.L. and the seal fixed on the alleged recovered items was deposited in the Malkhana. Hence, there is no complete chain of circumstances brought on the record. The prosecution story is doubtful and the accused is entitled to benefit of the doubt.

He has argued that although there is no eye witness to the occurrence but the circumstantial evidence produced by the prosecution is sufficient to connect the accused with the offence. He has supported the judgment passed by the learned trial Court and submitted that the impugned judgment calls for no interference hence, the learned Public Prosecutor prayed for dismissal of the appeal. 10. We have given thoughtful considerations to the rival submissions and perused the record carefully, we have also respectfully studied the law laid down in the citations placed before us. 11. Before we deal with the submissions made by the learned counsel for the appellant and learned Public Prosecutor, it would be appropriate to first consider the evidence produced by the prosecution. 12. (PW.1) Dr. Ved Prakash Sharma was the member of the Medical Board, which conducted autopsy on the dead body of deceased Dheer Singh and prepared the post mortem report (Ex.P.1). As per the statement of this witness, there was swelling on the right eye and the same was blackish. Left eye was depresrop, mouth was open with blood stains, there was blood on the right ear and brain matter was protruding. There were seven injuries on the body of the deceased and as per the opinion of the Medical Board, the cause of death was coma due to massive cranial injury and associated effect of hemorrhage both concealed and revealed due to the injuries as mentioned in the post mortem report. The injuries were ante mortem in nature. This witness has proved the post mortem report (Ex.P.1). He has also deposed that as per the FSL Report (Ex.P.2), no poison was found in the viscera of the deceased.

He has further cleared that the cause of death excessive bleeding from the head injury. 13. (PW.2) Om Prakash has proved the inquest report (Ex.P.5) of deceased Dheer Singh and stated that the same bears his signature. 14. (PW.3) Vishnukant has stated that on 24.4.2007, at about 5.30 A.M. he was returning home from the temple when he saw the body of the deceased in front of Sandsala near the Peeple tree. Blood was pooling on the road. On seeing the dead body, he went to Gajendra and told him about the same. The witness further disclosed that at about 7.30-7.45 A.M. police prepared the inquest report (Ex.P.5), site plan (Ex.P.6) and also recovered blood stained soil and controlled soil vide recovery memos (Ex.P.7) and (Ex.P.8). Two teeth, pant, a tea shirt and pair of shoes of deceased were recovered vide memo (Ex.P.9), (Ex.P.10) and (Ex.P.11) respectively. This witness has proved his signatures on the documents. 15. (PW.4) Natthu Singh has stated that about six and a half months ago, at about 8.30 A.M. he went to market to have a cup of tea where he saw the dead body of Dheer Singh lying aside the road. The police prepared the inquest report (Ex.P.5) of the dead body and also the site plan(Ex.P.6) of the place where the dead body lay and the documents bears his signatures. 16. (PW.5) Shiv Kumar has stated that on the night of 23.4.2007 at about 9.00 he had gone to the Bada of Narendra Singh. After some time Kalu also arrived there and we all of three consumed liquor. About 11.00 P.M. Devi Singh had also come there and Narendra asked him whether he wanted to have liquor, Devi Singh had refused saying that he had already had alchohal. At about 12.00 Devi Singh left from there and all of them also went to their respective houses. 17.

(PW.6) Om Prakash has stated that on the night of 23rd April at around 1.30 A.M. he was operating Boiler in the wooden factory of Shri Mahavir ji Saini, when Devi Singh came to him and asked for Ramesh Operator to which he caustically replied by saying that he could not possibly hope to find Ramesh operator in the factory at that hour of the day. Then Devi Singh told him that at about 6.00 P.M. he had received a phone call from Ramesh saying that he had some urgent work with him. The witness further stated that he told to him to see Ramesh at his house. The witness further stated that Devi Singh had told him that his nose was bleeding. There was blood on his clothes and he was frightened. 18. (PW.7) Narendra Singh has stated that at about 10.00 PM, he was at his house when Shiv Kumar and Kalu came to him. They had been consumed liquor in the Bada situated at the side of the house. At about 11.00 Devi Singh also joined them, who however, had refused to have liquor. At about 12.00, he and Shiv Kumar went to their house. At that time Devi Singh was wearing black pants and a white shirt. 19. (PW.8) Ramesh has stated that it was on the night of 23/04/2007 at about 1.30 Mahaveer, Murad, Ranvir and he were returning after dividing their shares of wheat. When they reached in front of the wooden factory of Mahaveer, they found Devi Singh sitting next to Om Prakash Nai. He further stated at that time, sleeves of Devi Singh's shirt was smeared with blood. Thereafter, he went to his house and had no knowledge of Devi Singh's whereabouts thereafter. His house is situated near to the Factory. 20.
When they reached in front of the wooden factory of Mahaveer, they found Devi Singh sitting next to Om Prakash Nai. He further stated at that time, sleeves of Devi Singh's shirt was smeared with blood. Thereafter, he went to his house and had no knowledge of Devi Singh's whereabouts thereafter. His house is situated near to the Factory. 20. (PW.9) Gajendra Singh has stated that on the evening of 23.4.2007 Dheer Singh, son of Sangram Singh, who is his cousin came to him and told him that Mahaveer Chamar, Raju Daroga, Sheeshpal, the father of accused Devi Singh had killed his goat and when he made complained, they threatened to kill him. He assured Dheer Singh to have a talk with them the next day. In the morning of 24.4.2007 at about 6.00 Vishnu Kant Mehrishi, Priest of Rani Sati Temple, Mahansar came to him and told that some body had killed Dheer Singh. He went near the Temple of Rani Sati and found the dead body of Dheer Singh near the peepal tree with injuries on several parts of his body and blood oozing out of those injuries. Then he went to Mahipal Singh and informed the police at about 6.30 AM and the police reached there at 7.00 AM. After he furnished the written report (Ex.P.12), police started investigation. Inquest report (Ex.P.5), site plan (Ex.P.6) were prepared and the controlled soil as well as the blood smeared soil were recovered and sealed. (PW.10) Mahaveer Saini has stated that on 23.4.2007 he, Murad, Mahaveer, Ramesh and one boy aged about 10-11 years returned to his factory at about 1.30 after dividing their share of wheat. At 1.30 A.M., they were sitting in his factory and Om Prakash Nai was operating a boiler. Devi Singh was at a distance of 50 meters and from that distance, he told Devi Singh that certain persons were waiting for him in his field. The field belonged to Sushil which was ploughed by Shishupal, father of Devi Singh. At that time Devi Singh was wearing a Kathai colour shirt. The next morning he heard about the murder of Dheer Singh. And two-three days, the police arrested Devi Singh.

On the 26th at around 2.00-2.30 PM, the police brought Devi Singh and recovered a bamboo lathi from the place as disclosed by him, which was taken into possession by the police. The police then prepared a Recovery Memo (Ex.P.15) in his presence. On the same day, the police had seized a pant and a shirt, belonging to Devi Singh and prepared Recovery Memo (Ex.P.16), which contains his signatures. Police also prepared site plan (Ex.P.17) of the place of recovery, which also contains his signatures. 22. (PW.11) Murad has stated that on the night of April 24th at about 1.30, Mahaveerji and four other people went Mahaveer's factory with wheat harvested from the field of Sushil, which they ploughed on half sharing basis. When they reached the factory, they found Devi Singh and Om Prakash Nai. Devi Singh did not talk to anybody in his presence and returned soon thereafter. He had no knowledge as to where Devi Singh had gone. On the same night, at about 2.00-2.15, Devi Singh had met him at the well when he along with one small boy was sleeping near the well and Devi Singh, who was urinating at some distance from the well called out to them and asked them to start the motor-pump. Apart from a request to start the motor-pump, nothing was disclosed by Devi Singh. This witness was declared hostile by the prosecution. 23. (PW.12) Ramotar has stated that on 24.4.07 at about 6.00 AM he came out of his house then found that on the road infront of his house, dead body of Dheer Singh was lying. Face of the body was smashed and 2-3 teeth were lying there. 24. (PW.13) Surendra Kumar is the photographer who photographed the dead body and has proved the same. 25. (PW.14) Surya Prakash has stated that on the night of April 23, 2007, he was at his home, which is situated in the Bazar. On the same day, a dispute regarding land had happened. At 10.00 in the night, he went to the Bazar where Dinesh Kumar Maskhara was sitting at the shop of Mahendra Nai.

He asked him to come to his house and after he did so, he showed Dinesh Kumar, the papers of the land over which dispute had been going on. He further stated that at around 11.00-11.30, they were sitting on the Chabutra situated outside the house and at about 12.30-12.45 heard noise of lathies coming from the side of the “Aushdhayala”. Just ten minutes prior to this, they had seen Devi Singh passing by on a cycle and even though he could not clearly see what Devi Singh was carrying on his cycle, perhaps it was a Lathi. Hearing noise of lathies, Dinesh Mashkhera and he went towards to site. They reached near the factory and immediately returned back and fell asleep. The next morning, he got to know that Dheer Singh had been killed. 26. (PW.15) Dinesh Kumar has deposed that on 23rd April, 2007, at about 10.00 PM, after having his meals at home, he went to the shop of Mahendra Nai, which is located in the market. Surya Prakash who was standing there, asked him to accompany him to his house and thus, he went along with him. There was some dispute going on between Surya Prakash and Pawan regarding some land. He reached the house of Surya Prakash at about 11.00 PM and saw the papers and then went to the Chabutra of Surya Prakash which was outside of the house. They kept talking there for a while. About 12.30, Devi Singh came from the side of Maniyaron Ka Chowk on a cycle. Devi Singh got down from the cycle since its chain had broken down. Since he was busy talking, he did not pay attention to the cycle and the thing Devi Singh was carrying thereon. After some time, Devi Singh headed towards the “Aushdhayala”. Within ten minutes after this, they heard the noises of lathies coming from some distance. Hearing such noises, Surya Prakash told him about the fight and he along with Surya Prakash went towards the “Aushdhayala”.

The factory of one Khati is situated at a distance of 150 feet from the hospital. When they entered the factory, they found two workers working there. They were pushing a Keela, so they thought that the noise they heard would have been produced because of the work being done by the workers at the factory. Hence, they went to their respective houses and slept. On the next day, his nephew told about the murder of Dheer Singh. His nephew also asked him whether he was in the market last night. 27. (PW.16) Ram Chandra is a police constable, who deposited six sealed packets along with letter of request at FSL, Jaipur and got receipts of the same which are (Ex.P.28) and (Ex.P.29) respectively. In his re-examination he has stated that he deposited four sealed packet at F.S.L. on 02/05/2007 vide (Ex.P.30). 28. (PW.17) N.K. Maurya has stated that on 24.4.2007 he was posted as Incharge of the Forensic Science Laboratory, Unit, Churu. On the basis of telephonic instructions received from the Head Quarters, Jaipur, he along with Anil Kumar, Laboratory Assistant and Mahipal Singh, Assistant Laboratory Assistant reached the place of occurrence and inspected the dead body. Blood was polling near the dead body and up to the wall of Sandshala. He also found pieces of broken teeth and bones and, instructed the police to collect the same and send the same to the FSL, Jaipur. The site inspection report is (Ex.P.31). They also took photographs of the place of occurrence from the departmental digital camera. Photographs are (Exs.P.32 to P.38). 29. (PW.18) Laxman Singh, at the relevant time was posted as constable at the Police Station Bisau. He has stated that Shri Sunil Kumar Gupta, SHO, handed over the written report (Ex.P.12) to him for registration of formal FIR at the Police Station, which he handed over to Hawa Singh Head Constable at the police station. On 25.4.2007, Station House Officer arrested accused Devi Singh in his presence and the arrest memo (Ex.P.39) contains his signatures. 30. As per his statement, on 24.4.2007, eight sealed packets were deposited at the instance of SHO/IO as evidence and two sealed packets were deposited on 26.4.2007. The sealed packets were sent to FSL, Jaipur on 28.4.2007 through constable No.358. 31. (PW.20) Karanpal Singh has stated that it was two years ago when Devi Singh, the accused, had come to him at about 8.00-8.30 PM, had given him Rs.100/-and asked him to bring a bottle of liquor. He brought the liquor bottle as asked and handed it over to Devi Singh. At about 9.00-9.30, he took his cycle and went to the bazar where Devi Singh met him and asked for his cycle for 10-15 minutes. He handed his cycle over to him, after which, he waited for Devi Singh for about one hour but Devi Singh did not turn up with the cycle. After so waiting, he went to his house. At about 6.00 in the morning, he was in the need of the cycle and so, his cousin brought the cycle back. On the same day, his father told him about the murder of Dheer Singh. 32. (PW.21) Sampat Singh has stated that it was 2-2 ¼ years ago when on one night, he was sleeping at his house and his Bhabhi, Sada Kanwar, came to him around 11.30 P.M. and told him that the accused-Devi Singh had taken his brother (the deceased) to settle the matter regarding the goat and that the deceased had not returned home till then. She had also asked him to call Dheer Singh, then he went in search of him to the market place. When he reached near the Rani Sati Temple, he saw Devi Singh hitting Dheer Singh on his head with a long Lathi. In his presence, he inflicted 7-8 blows on Dheer Singh's head and legs. When he tried stopping and asking the accused the reasons for hitting Dheer Singh, the accused Devi Singh asked him to leave and warned him about the same fate if he did not do so. He got frightened, went home and slept.

At night about 2.30-3.00 he received a call from his brother-in-law (sister's husband) who informed him that their son had taken ill and so, he rushed to Jaipur where his sister's son had been admitted. He returned to the village after 2-3 days. 33. (PW.22) Mahipal Singh has stated that on 24th April, 2007 at about 6.00-6.15, Gajendra Singh came to his house and told him about the murder of Dheer Singh. He went at the place of occurrence and found the dead body of Dheer Singh lying there. The head and face were full of blood and the jaw was broken. He had himself informed the police. He further stated that Devi Singh had come to him on the night of 23rd April, 2007 at about 11:30-12.00 P.M. When he was over-seeing the construction of the road and had asked him as to when the construction would get compeleted. Devi Singh left soon after he had replied to his question. At that time Devi Singh was frightened. 34. (PW.23) Sada Kanwar, who is the wife of the deceased Dheer Singh has stated that it was about 2-2 ¼ years ago, when on one usual night she along with her husband was at her house and at about 9.00 PM, Devi Singh came to their house to call her husband for settling the matter regarding the goat and took her husband with him. After one and half hours when her husband did not return, she went to her brother-in-law (Devar) and told him that the deceased had gone with Devi Singh but had not returned. She also asked him to go in search of the deceased. Her Devar Sampat Singh did not return and in the morning she came to know about the murder of her husband. 35. (PW.24) Sunil Kumar is the Investigating Officer of the case, has stated that on 24.4.2007 he was posted as Station House Officer, Police Station Bisau.

On the same day, Gajendra Singh resident of Mehansar submitted a written report (Ex.P.12) at the place of occurrence, which was sent to the police station for lodging of a formal FIR and necessary action through constable Laxman Singh on the basis of which formal FIR (Ex.P.13) was registered at the police station which bears signatures of Laxman Singh and Hawa Singh, Head Constable. Investigation of the same was handed over to him and the original FIR was handed over to him by Laxman Singh at the place of occurrence. Inquest report (Ex.P.5) of the dead body was prepared in the presence of the witnesses and a site plan (Ex.P.6) was also prepared which contains signatures of the witnesses. Blood stained soil was recovered through recovery memo (Ex.P.7), which contains signatures of the witnesses. Thereafter, controlled soil was recovered through recovery memo (Ex.P.8) in presence of the witnesses. Recovery memo (Ex.P.9) of two broken teeth of the deceased Dheer Singh was also prepared. The clothes of the deceased were recovered through recovery memo (Ex.P.10) and one pair of used shoes of the deceased was also recovered through recovery memo (Ex.P.11). The dead body of the deceased was handed over to Gajendra Singh through receipt (Ex.P.14). During investigation, statements of witnesses, namely; Murad Khan, Om Prakash, Gajendra Singh, Mahaveer Prasad, Sampat Singh, Smt. Sada Kanwar, Vishnukant, Mahipal Singh, Abhimanyu Singh, Kalu @ Kishore Singh, Shiv Kumar, Narendra Singh, Ramesh, Surendra Kumar Sharma, Vishambhar @ Patel and Kamal @ Kalu were recorded. Accused Devi Singh was arrested through arrest memo (Ex.P.39). During custody, accused Devi Singh furnished information under Section 27 of the Evidence Act (Ex.P.41) regarding the lathi, pant and shirt and pursuant to the information, there was recovery of one bamboo lathi through recovery memo (Ex.P.15) and a pant and a shirt through recovery memo (Ex.P.16). Site plan (Ex.P.17) regarding recovery of Lathi, pant and shirt was prepared. During investigation, the dead body was photographed and the photographs are (Exs.P.19 to P.27). The recovered articles were sent to FSL, Jaipur for testing.

The above witnesses were cross-examined at length but nothing contradictory could be elicited from them, which could through doubt on their testimony. 37. A bare perusal of the impugned judgment it would reveal that the learned trial court has based its judgment of conviction on the following circumstances:- 1. The accused took deceased with him on the pretext of settlement of dispute of killing of the goat; 2. Accused was seen by the witnesses near to the place where the dead body of deceased Dheer Singh was found; 3. Recovery of blood stained lathi on the basis of information furnished by the accused appellant; 4. The accused was seen by the witnesses with blood stained clothes and the accused could not explain the same; and 5. Motive of the offence. 38. There is no denying the fact that there is no eye witness to the occurrence, which took place on the night of 24/04/2007, in which the deceased Dheer Singh was brutally killed. The case of the prosecution solely rests on circumstantial evidence. 39. From the evidence of Doctor Ved Prakash (PW.1), it is clear that the injuries received by the deceased were homicidal. Now The question is whether the prosecution has been able to connect the accused with this offence. Sada Kanwar (PW-23) is the wife of the deceased and from her evidence it is clear that on the night of the incident, at about 9:00 PM, the accused had visited their house and had taken the deceased along with him for settling the matter regarding the killing of the goat. 40. When the accused and the deceased did not return even after one and a half hours, Smt. Sada Kanwar informed (PW.21), Sampat Singh and also requested him to go in search of them. However, Sampat Singh did not come back with any news and the next morning, she came to know about the murder of her husband. The statement of this witness is fully corroborated with statement of Sampat Singh (PW.21). Both these witnesses were cross examined at length but nothing contradictory could be elicited from them, which could throw doubt on their testimony.

From the evidence produced on record it is clear that there was a dispute between the accused and the deceased regarding the killing of a goat belonging to the deceased and for settling this matter the accused had taken the deceased alongwith him from his house at around 9:00 P.M. and thereafter, neither the accused nor the deceased returned home. Rather, the dead body of the deceased was recovered the next morning. It stands established that the deceased was last seen in the company of the accused before the incident took place and motive of the offence is also established from the above evidence. The fact that the accused had consumed liquor on the midnight of 24/04/2007 is also proved from the statement of Shiv Kumar (PW.5) and Narendra Singh (PW.7). Om Prakash (PW.6) has also proved that there was blood on his clothes and he was frightened too. These facts also speak volumes against the accused. Although in his statement under Section 313 Cr.P.C. the accused has stated that it was his own blood due to “Nakseer”, from the F.S.L. report (Ex.P.45) it is established that the blood stains recovered from the clothes of the accused tallied with the samples of blood of the deceased. 41. It is also worth noting that no suggestion has been given on behalf of the accused to the prosecution witnesses that the blood found on his body and clothes was the blood of the accused himself which oozed out of his nose due to “Nakseer”. 42. From the statement of Sunil Kumar (PW-24), who is the Investigating Officer of the case, it is proved that after his arrest and on the basis of the statement given by the accused under Section 27 of Evidence Act, a lathi, trouser, and a shirt were recovered from the possession of accused through recovery memos (Ex.P.15) and (Ex.P.16). Mahaveer (PW.10) has proved the recovery memos (Ex.P.15) and (Ex.P.16). The fact that the accused was carrying the lathi on cycle at night is also proved from the statement of Suray Prakash (PW.14).

Ram Chandra (PW.16) has proved that ten sealed packets were deposited by him in sealed condition. From F.S.L. report (Ex.P.45) too it is clear that the aforesaid articles were deposited in sealed condition. Circumstance No.1. 43. To prove the fact the prosecution has placed reliance on the evidence of Gajendra Singh (PW.9), Sampat Singh (PW.21) and Sada Kanwar (PW.23). 44. Gajendra Singh (PW.9) has stated that on the evening of 23rd April, 2007, deceased Dheer Singh came to him and told him that Mahaveer Chamar, Raju Daroga and Sheeshpal (father of the accused) had killed his goat and when he complained to them, they threatened him. Similarly, Sampat Singh (PW.21) has stated that on the night of 23rd April, 2007, wife of the deceased Dheer Singh had come to him and told that Devi Singh had taken the deceased for the purpose of resolving the dispute regarding the goat and asked him to go in search of him. He went in search of him but could not find him. 45. Sada Kanwar (PW.23) has deposed that at about 9.00 PM on the fateful night Devi Singh had come to her house and asked her husband to accompany him for the purpose of settling the dispute regarding the killing of the goat and thereafter her husband did not return and the next morning his dead body was found. Circumstance No.2. 46. Though there is no evidence available on record to show that the deceased was last seen with the accused near the place where his dead body was found, the prosecution has been able to establish that the accused-appellant took the deceased Dheer Singh with him on the pretext of settling the dispute regarding the goat and thereafter the deceased was not seen alive. Circumstance No.3. 47. To prove recovery of the blood stained lathi the prosecution has placed reliance on the testimony of Mahaveer Saini (PW.10), Murad (PW.11) and Sunil Kumar (PW.24). 48.

(PW.24) Sunil Kumar who is the Investigating Officer of the case has stated that on the basis of the information given by the accused under Section 27 of the Evidence Act which was also reduced in writing and bears the signature of the accused, blood stained lathi and clothes of accused were recovered in the presence of witnesses Mahaveer Saini (PW.10) and Murad (PW.11). 49. Mahaveer Saini, (PW.10) has deposed that the police brought the accused in custody and from the spot disclosed by the accused, bamboo lathi was recovered, which was seized and sealed. Site plan was also prepared in his presence. The seizure memo and the site plan contain his signatures. 50. As per the FSL report (Ex.P.45) human blood of `A' group was found on the lathi, pant and shirt. Circumstance No.4. 51. Om Prakash-(PW.6) has stated that on the night of 23rd he was operating a boiler when Devi Singh came to him and asked him about Ramesh Operator. At that time, he saw blood on Devi Singh's. Ramesh (PW.8) also stated that when Devi Singh was sitting near to Om Prakash Nai, he saw blood on his shirt. Circumstance No.5. 52. So far as the motive of the murder is concerned, the prosecution has been able to prove from the evidence of Gajendra Singh (PW.9), Sampat Singh (PW.21) and Sada Kanwar (PW.23) and from the written report (Ex.P.12) that there was a dispute between the father of the deceased and the accused regarding killing of a goat belonging to the deceased-Dheer Singh. In the written report (Ex.P.12) the fact that there was a dispute going on regarding killing of the goat of deceased Dheer Singh was clearly mentioned. 53. The learned trial Court has relied upon the evidence of Murad (PW.11), who has stated that he had seen Devi Singh near the well on the night of occurrence. This witness has also proved his signature of recovery memo (Ex.P.15) and (Ex.P.16). But the learned trial court did not put these circumstances before the accused while examining him under Section 313 Cr.P.C. In the absence of such examination no reliance can be placed upon the statement of Murad (PW.11).

However, even if we exclude the statement of Murad (PW.11), the chain of circumstances brought on record is so clear and clinching that the same unerringly points towards the guilt of the appellant-accused. Need less to say that the recovery memos (Ex.P.15) and (Ex.P.16) have also been proved by (PW.10) Mahaveer Prasad and Sunil Kumar (PW.24). 54. In view of the discussions made hereinabove, it is clear that while finding the accused guilty, the learned trial court has discussed the evidence in true prospective, which calls for no interference. In the result, we find no illegality in the impugned judgment of conviction and sentence. The appeal has no merit and the same is accordingly, dismissed.
