JUDGMENT Arvind Kumar Mishra-I, J. Supplementary affidavit filed on behalf of the applicant is taken on record. 2. Heard learned counsel for the applicant as well as learned AGA for the State of U.P and perused the material available on record. 3. Contention raised on behalf of the applicant has been confined to the extent that the very centre point of the dispute is alleged to have arisen because of some misunderstanding between the first informant and the applicant. The entire amount so claimed has been received by the first informant Amit Kumar. Copy of his statement as recorded before the trial court has been annexed as SA-I to the affidavit filed in support of the supplementary affidavit. Therefore, nothing remains to be done regarding the alleged offence. Co-accused Sonu Thakur @ Pankaj Handa has already been enlarged on bail by this Court vide order datted 15.07.2015 in criminal misc. bail application no.24796 of 2015. The applicant does not bear any criminal history to his credit and is languishing in jail since 25.04.2015 in the present case. 4. Learned AGA has opposed prayer for bail. However, learned AGA has not disputed the aforesaid facts. 5. Without expressing any opinion on merits of the case but considering the facts and circumstances of the case, nature of accusation and the severity of punishment in case of conviction and the nature of supporting evidence, reasonable apprehension of tampering with witness or apprehension of threat to the complainant and prima facie satisfaction of the Court in support of the charge, the applicant is entitled to be released on bail. Accordingly, bail application is allowed. 6. Let the applicant Ajay Sharma @ Uma Shanker involved in Case Crime No.184 of 2015, under Sections 420, 468, 406, 504, 506 I.P.C., Police Station Sadar Bazar, District Meerut be released on bail on his executing a personal bond and furnishing two sureties each in the like amount to the satisfaction of the court concerned.
