body2015
JUDGMENT (Per F. M. Reis, J) Heard Mr. P. A. Kamat, learned counsel appearing for the petitioner and Mr. P. Dangui, learned Additional Government Advocate appearing for the respondent no.1. 2. Rule. Heard forthwith with the consent of the learned counsel. 3. The learned counsel appearing for the respective respondents waive service. 4. During the course of the hearing of the above petition, the learned Additional Government Advocate has produced a show cause notice dated 28.08.2015 issued by the respondent no.1 to the respondent no.4 in connection with the subject premises. As the respondent no.1 has already initiated action with regard to the subject premises, the grievance of the petitioner at this stage stands substantially redressed. Needless to say that all the contentions of the respondent no.4 with regard to such show cause notice are left open as we have not examined the correctness of the allegations made by the petitioner in the above Writ Petition. Hence, the above petition stands disposed of by directing the respondent no.1 to take a decision with regard to the said show cause notice dated 28.08.2015 as expeditiously as possible preferably within six months. All contentions of both the parties on merits are left open. The petitioner if so advised is at liberty to file an application for intervention with the concerned authorities which shall be examined on its own merits in accordance with law after hearing the concerned parties. The petition stands disposed of accordingly.
