JUDGMENT Ramesh Sinha, J. Heard Sri A.S.Rai, learned counsel for the applicant, Sri Manish Dev, learned A.G.A. for the State and perused the record. 2. This application under Section 482 Cr.P.C. has been filed for quashing the impugned FIR dated 22.6.2015 filed under sections 147, 148, 149, 353, 332, 307, 336, 504, 506, 427, 34 I.P.C., Section 21(4) of Mines and Minerals Act and Section 7 Criminal Law Amendment Act, registered as case crime no.315 of 2015, police station-Jakhlaun, District Lalitpur, along with entire proceedings in pursuance thereof. 3. It has been pointed out by the learned AGA that the applicant has earlier preferred a writ petition for quashing of the impugned FIR being Crl. Misc. Writ Petition No.17217 of 2015, which has been dismissed by this Court vide order dated 20.7.2015, copy of which has been annexed at page-28 of the application. The applicant has again approached this Court by filing the present 482 Cr.P.C. application with the same prayer, to which learned counsel for the applicant states that some new facts have arisen and on account of which the present 482 Cr.P.C. application has been filed. 4. After having very carefully examined, the submissions made by the learned counsel for the applicants and perused the material brought on record, in my opinion, as the applicant has already approached this court by filing a writ petition which has been dismissed, hence, no ground for interference is made out by this Court. The application lacks merit and is, accordingly, dismissed.
