JUDGMENT Ran Vijai Singh, J. Heard Sri Indra Raj Singh Yadav, learned counsel for the applicant and Sri Sahab Tiwari, learned counsel for the opposite party. 2. This contempt application has been filed for punishing the opposite party for willful disobedience of the order dated 25.3.2015 passed by this Court in Writ C No. 15701 of 2015 (Rajveer Singh Vs. State of U.P. and Others) by which the writ petition was disposed of with the direction to the petitioner/applicant to file an application for regularization of his account and in the event of filing of such application, the respondent-Bank was directed to provide the statement of account to the applicant as on 31.3.2015 and permit the applicant to pay the defaulted amount in one installment within a period of four weeks and thereafter, the applicant was to be permitted to pay the amount as per the original installment fixed by the Bank. 3. Considering the submissions of the learned counsel for the applicant, on 15.7.2015, this Court has passed the following order: "This contempt application has been filed for punishing the opposite party for willful disobedience of the order dated 25.3.2015 passed by this Court in Writ C No. 15701 of 2015 (Rajveer Singh Vs. It is stated that even after the submission of application and deposit of the amount, the applicant is not being permitted to deposit the monthly instalment. Sri Sahab Tiwari, learned counsel who is appearing for the Bank-opposite party is directed to seek instructions in this matter. As prayed, put up as a fresh case on 30.7.2015 showing name of Sri Sahab Tiwari as counsel for the opposite party. " 4.

Pursuant thereto, Sri Sahab Tiwari, learned counsel for the opposite party, has sought instructions and filed counter affidavit, from the perusal of which, it transpires that according to the present status of the account, the applicant is only required to deposit the monthly installments of Rs. 15,000/- per month. So far as arrears is concerned, that has already been deposited. 5. In view of the statement made in the counter affidavit, I do not find it to be a fit case where willful disobedience of the order dated 25.3.2015 passed by this Court in Writ C No. 15701 of 2015 can be inferred. The contempt application is dismissed without issuing notice to the other side.
