This revision has been filed under section 53 of Juvenile Justice (Care and Protection of Children) Act, 2000 (hereinafter referred to as "the Act") against the judgment dated 30-10-2014, delivered in Criminal Appeal No. 305/2014, whereby learned 12th Additional Sessions Judge, Jabalpur has refused to release Manjeet Ladiya on Supurdnama of his father Bharatlal. 3. There is no dispute that Manjeet Ladiya as Juvenile is facing trial for Crime No. 119/2014, registered at Police Station Bhedaghat, District Jabalpur, for the offences punishable under sections 450, 394 and 395 of Indian Penal Code. 4. Learned counsel for the applicant has placed reliance on decision in Dushyant vs. State of M.P., 2012(1) M.P.H.T. 233 and contended that petitioner who is a juvenile is not a criminal, therefore, his release would not defeat the ends of justice. On the other hand, refusal of bail would be against the intention of the Act. 5. Learned counsel appearing for the respondent-State has opposed the prayer. 6. Once a person is held to be a juvenile delinquent, then under the Act the bail to him can only be refused if there appears to be a reasonable ground for believing that his release is likely to bring him into association with any known criminals or expose him to moral danger or his release would defeat the ends of justice. Accordingly, the revision is allowed. Impugned judgment dated 30-10-2014, delivered in Criminal Appeal No. 305/2014, by learned 12th Additional Sessions Judge, Jabalpur is liable to be and is set aside. 7. Looking to the facts and circumstances of the case, Manjeet Ladiya deserves to be released on Supurdnama of his father. 8. It is directed that on furnishing a bail bond of Rs. 10,000/- (Rupees Ten Thousand Only) by father of Manjeet Ladiya with one surety in the like amount to the satisfaction of Juvenile Court, Jabalpur, Manjeet Ladiya be given in the custody of his father on Supurdnama, for his regular appearance during the trial. It is further directed that father of Manjeet Ladiya shall take care of him and keep him in his custody and shall not permit him to come into association of bad persons. 9.
