Judgment 1. The petitioner herein is the wife and the respondent is the husband. The respondent husband filed H.M.O.P. No. 75 of 2011 on the file of the Sub Court, Vellore, for divorce and the same is pending. 2. Though notice was sent to the respondent, he has not chosen to appear before the Court. 3. Heard the learned counsel for the petitioner. 4. It is well settled law that whenever, the transfer application is filed in matrimonial disputes, the convenience of wife shall be given preference. Furthermore, the respondent has not chosen to appear before the Court. Therefore, I am of the view that the petition filed by the wife is liable to be allowed. 5. Accordingly, the petition is allowed and H.M.O.P. No. 75 of 2011 is hereby withdrawn from the file of the Sub Court, Vellore and transferred to the file of the Principal Sub Judge, Trichy. The learned Sub Judge, Vellore is directed to send the case bundles to the Court of the Principal Sub Judge, Trichy immediately. The Registry is also directed to send back the papers that are pending before the Registry. No costs. Consequently, connected miscellaneous petition is also dismissed.
