JUDGMENT : Mansoor Ahmad Mir, J. This appeal is directed against the judgment and award, dated 30th April, 2007, made by the Motor Accident Claims Tribunal, Kullu, H.P. (for short "the Tribunal") in Cl. Pet. No. 43/06, titled as Smt. Saroj versus Ramveer and others, whereby claim petition came to be granted and compensation to the tune of ` 38,000/- with interest @ 7% per annum from the date of the petition till its realization came to be awarded in favour of the claimant-injured (for short "the impugned award"). 2. The owner-insured, the insurer and the driver have not questioned the impugned award on any count, thus, has attained finality so far it relates to them. 3. The appellant-claimant-injured has questioned the impugned award only on the ground of adequacy of compensation. 4. Admittedly, the appellant-claimant-injured was admitted in Zonal Hospital, Kullu on 02.10.2004, was referred to PGI Chandigarh on 04.10.2004, remained admitted there for ten days and has suffered 25% permanent disability in terms of Exhibit PW-4/A, had undergone pain and sufferings. 5. The Tribunal has not granted adequate compensation. The appellant-claimant-injured was entitled to ` 25,000/- under No Fault Liability and only a sum of ` 13,000/- has been awarded under various heads, which, on the face of it, is meager. 6. Accordingly, the appellant-claimant-injured is held entitled to ` 50,000/- more under the heads 'pain and sufferings', 'medical charges' and 'attendant charges'. 7. Viewed thus, the appeal merits to be allowed. Accordingly, the appeal is allowed and the impugned award is modified, as indicated hereinabove. 8. The insurer is directed to deposit the enhanced amount of compensation before the Registry within six weeks. In default, the insurer shall be liable to pay interest @ 7.5% on the enhanced amount from today. 9. On deposition of the same, the entire awarded amount be released in favour of the appellant-claimant-injured strictly as per the terms and conditions contained in the impugned award after proper identification. 10. Send down the record after placing copy of the judgment on Tribunal's file.
