Judgment :- 1. The petitioner is aggrieved against the order of suspension dated 03.12.2014. 2. Heard the learned counsel appearing for the petitioner and the learned Standing Counsel appearing for the respondent. 3. It is seen that the petitioner was placed under suspension by the impugned order, dated 03.12.2014, based on certain allegations. In similar circumstances, this Court has considered and passed orders in respect of the employees working under the respondent corporation, directing the respondent to initiate the disciplinary proceedings and complete the same and pass final orders within a period of three months and also to pay subsistence allowance during the period of suspension. It was also made clear therein that if no disciplinary proceedings is initiated and final order is passed within the time stipulated, the respective petitioners therein are entitled to be reinstated into service immediately thereafter. 4. Considering the above said facts and circumstances, this Writ Petition is disposed of by passing the following order:- (a) It is open to the respondent to initiate disciplinary proceedings against the petitioner and if any such proceedings is initiated, the same shall be completed and final order shall be passed within a period of three months from the date of receipt of a copy of this order. (b) The petitioner shall be paid subsistence allowance from the date of suspension till the respondent passes the final orders in the disciplinary proceedings. (c) If the respondent does not initiate any disciplinary proceedings as stated supra and pass final orders within the time stipulated, the petitioner is entitled to be reinstated into service immediately thereafter. Consequently, connected Miscellaneous Petition is closed. No costs.
