JUDGMENT Ashwani Kumar Singh, J. Heard learned counsel for the petitioner and learned State counsel. 2. By means of this petition filed under Section 4 07 Cr.P.C., the petitioner has prayed to transfer the case no. 2464 of 2014(State versus Arvind Kumar and others) arising out of case crime no. 15 of 2014 under Sections 498A, 325, 504 and 506 I.P.C. and Section 3 /4 Dowry Prohibition Act, police station Mahila Thana, district Gonda pending in the court of learned Chief Judicial Magistrate, Gonda to any other court of Sant Kabir Nagar. 3. Learned counsel for the petitioner states that the petitioner has threat perception from opposite party nos. 2 to 7 who are accused in the above-mentioned case, as such, the aforesaid case may be transferred from learned Chief Judicial Magistrate, Gonda to another court of Sant Kabir Nagar. 4. Considering the submission of learned counsel for the petitioner, I do not find any good ground to transfer the case from the court of district Gonda to another court of Sant Kabir Nagar. 5. However, it is provided that if petitioner moves appropriate application before the court concerned, if he apprehends danger to his life on his appearance before the concerned court on the date fixed, the learned court after considering the prevailing circumstances may pass appropriate order for personnel security and safety of the petitioner on the date fixed for his appearance before the court. With the above direction, the petition is finally disposed of.
