JUDGMENT Muzaffar Hussain Attar, J. (Oral) – The respondent university after verifying the testimonials of the petitioner admitted her to undergo P.G. course in Mass Communication and Journalism in the year 2011. 2. Thereafter the respondents raised dispute about the eligibility of the petitioner on the ground that she had got the Bachelors degree which could make her eligible for seeking admission in P.G course, through distance mode which was not recognised by University of Kashmir. 3. The petitioner filed the writ petition on 27th July, 2011 in which respondents were directed to maintain status of the petitioner till next date. 4. Interim direction thereafter was continued. 5. With the passage of time the petitioner has not only completed the course, but has successfully qualified the same but the degree certificate has not been awarded to her by the respondent university. 5. Learned counsel for the petitioner in support of his contention submitted that respondent university is duty bound to issue the degree certificate to the petitioner. Learned counsel referred to Judgment of the Supreme Court reported in (1989) (1) SCC 399, (1976) (1) SCC 311, (1990) (3) SCC 23 and (1988) SCR (1) 368 and submitted that in view of the law laid down in the aforesaid Judgments, the respondents are duty bound to issue the P.G. degree certificate in favour of the petitioner. 6. It is not the case of the respondent university that petitioner secured admission by practicing fraud on the authorities. The only issue raised is that the graduation degree has been obtained by the petitioner through distance mode which is not recognised by them. 7. At the time the petitioner was granted admission in P.G. course, the concerned authorities of the respondent university must have applied their mind to the testimonials produced by the petitioner and only thereafter she has been given admission. The respondent university in the facts of this case now cannot deny issuance of P.G. degree certificate in her favour. Denying of P.G. degree certificate to the petitioner who has successfully qualified the two years course would not only be unfair but unjust as well. 8. For the above said reasons this petition is disposed of along with connected IA's and respondent university is directed to issue the P.G. certificate in Mass Communication and Journalism which the petitioner has completed and qualified.
