JUDGMENT : N. Paul Vasanthakumar, J. 1. This appeal is filed against the order dated 30.04.2015 made in OWP no.748/2015. 2. The main grievance of the appellants is that inspite of filing Caveat on 24.04.2015, the Registry has not put up the Caveat alongwith OWP no. 748/2015 and interim order was passed on 30.04.2015 by the learned Single Judge. 3. Learned counsel appearing for the respondents, on the other hand, submits that the order having been passed in exercise of jurisdiction conferred under Section 104 of the Constitution of Jammu and Kashmir which is akin to Article 227 of the Constitution of India, the intra court appeal is not maintainable in view of the Full Bench judgment of this Court rendered in Astral Traders v. Haji Mohammad Shaban Sofi, KLJ 1982 page 324. 4. We have also seen the order passed by the learned Single Judge. The learned Single Judge, while issuing notice in CMP, granted stay and directed the parties to maintain status quo with regard to suit property and directed to list the matter after notice period. 5. Even though the Registry was not right in not putting up the Caveat alongwith the writ petition, the order impugned is not causing any prejudice as only order of status quo was granted. The appellants can very well approach the learned Single Judge for modification of the order impugned. 6. In such view of the matter, we are unable to entertain the appeal. The appeal is, accordingly, dismissed granting liberty to the appellants to approach the learned Single Judge for modification of the order impugned. 7. Registry to post the writ petition before the roster Bench on 01.06.2015.
