JUDGMENT Manoj Misra, J. Heard learned counsel for the applicant, learned A.G.A. for the State and perused the record. 2. The instant applicant, under Section 482 Cr.P.C., has been filed challenging an order dated 03.01.2015 passed by the Additional Chief Judicial Magistrate, Court No.1, Mathura by which an application of the applicant for amendment of the charge has been dismissed for non prosecution. 3. A perusal of the order dated 03.01.2015 would go to show that neither the applicant nor his counsel has appeared to press the said applicant and since the proceedings were getting delayed on account of pendency of the application, the court below rejected the application for non prosecution. 4. Under the circumstances, this Court does not find any error in the order dated 03.01.2015. If the applicant is aggrieved, he can always move a fresh application and press the same before the court concerned. The application is dismissed.
