ORDER 1. Heard counsel for the parties. 2. As short question is involved being detention matter, petition is taken up for final disposal forthwith, by consent. 3. This petition under Article 226 of the Constitution of India takes exception to the detention order passed against the petitioner by the District Magistrate, District Chhatarpur, dated 22.12.2014, in exercise of powers under section 3(1) read with section 3(2) of the Prevention of Black Marketing and Maintenance of Supplies of Essential Commodities Act, 1980. 4. For the grounds on which we are inclined to allow this writ petition and quash the detention order operating against the petitioner, it is not necessary to dilate on the factual matrix in detail which culminated with the impugned detention order dated 22.12.2014. Suffice it to observe that the said detention order Annexure P-1 was served on the petitioner along with the grounds of detention Annexure R-4. The subjective satisfaction recorded by the Detaining Authority on the basis of the documents/material noted in the grounds of detention, admittedly, were not supplied to the petitioner. Merely serving the copy of the grounds of detention referred to above, along with the impugned detention order, in our opinion, is not enough. It is well established position that the documents on which reliance has been placed by the Detaining Authority to form his subjective satisfaction must be made available to the detenu along with the grounds of detention served on him, to enable him to make an effective representation. Non-supply of such vital documents, which are the foundation for subjective satisfaction recorded by the Detaining Authority, is fatal and the consequence is that the continued detention of the detenu is vitiated. 6. Accordingly, this petition ought to succeed on this count alone and the impugned detention order deserves to the quashed and set aside. The petitioner be set at liberty forthwith unless required in connection with any other criminal case. 7. We order accordingly. 8. We place on record a word of appreciation for the able assistance given by Shri Radhe Lal Gupta, Advocate as amicus curiae, whom we had appointed having realised that the petitioner’s wife was not in a position to espouse the cause of the petitioner, who was appearing in person.
