JUDGMENT Ramesh Sinha, J. Heard Sri N.K. Singh, learned counsel for applicant and Sri Ashok Kumar Yadav, learned AGA appearing for the State. 2. By means of this application under Section 482 Cr.P.C. the applicant has prayed that this Court may be pleased to set aside the order dated 10.02.2015 in ST No. 217 of 2006 (Case Crime No. 531 of 2005) under Sections 498-A, 504, 506, 420, 406, 109, 313 IPC, PS Majhola, District Moradabad pending before Fast Track Court, Moradabad. 3. Learned counsel for applicant submits that applicant is complainant of the present case and this case pertains to year 2006. Further submission is that the trial of this case has not yet been concluded and the presence of accused persons has been exempted by the trial Court on an application moved by them vide impugned order dated 10.02.2015 and by the same order the application paper 276Kha moved by the applicant for cost and rejection of the application for exempting their presence has been rejected. 4. From perusal of the impugned order, it appears that the presence of accused persons has been exempted in view of the provisions of Section 273 Cr.P.C wherein it is provided that it is not necessary that accused should be present personally for evidence in case his counsel is present in Court during recording of evidence. 5. In view of the above, there appears no ground for quashing the impugned order. 6. The application under Section 482 Cr.P.C. has no merit and it is accordingly dismissed.
