The present second appeal under Section 100 of the Code of Civil Procedure has been filed by the appellant defendant in a suit for eviction against the judgment and decree dated 24.05.1995 passed by the learned Civil Judge (Senior Division), Mount Abu, Camp-Abu Road in Civil Appeal Decree No. 05 of 1992 (37 of 1987) "LRs of Bhur Mal v. LRs of Madan Lal" by which, the learned First Appellant Court has affirmed the judgment and decree dated 25.07.1987 passed by the learned Munsif and Judicial Magistrate, First Class, Abu Road in Civil Original Suit No.122/1984 "Madan Lal S/o Rameshwar Lal v. Bhur Mal S/o Poonam Chand" by which, the learned Trial Court had decreed the suit of the plaintiff-Madan Lal on the ground of default in payment of rent and directed eviction of the tenant-defendant-Bhur Mal. 2.

While admitting the present second appeal on 05.07.1995, a coordinate Bench of this Court has framed the following substantial question of law for consideration by this Court:- "1. Whether the courts below erred in law in interpreting the Section 13(1)(a) of the Rajasthan Premises (Control of Rent and Eviction) Act, 1950 ? 2. Whether the courts below had no jurisdiction to pass decrees despite the fact that the rent has already been deposited in the courts below filing of the suit by the landlord ? 3. Whether the courts below had no jurisdiction to adjudicate upon the alleged default which was committed three years before the filing of the suit ?" 5. The learned counsel, Mr. Hemant Ballani & Mr.

The learned counsel, Mr. Hemant Ballani & Mr. V.D. Vaishnav on behalf of Mr. Vikas Balia, appearing for the appellant-defendant-tenant submitted that since in the rent notes in question (Ex. A.1 to A.13) by which the rent has been deposited by the tenant under Section 19-A of the Rajasthan Premises (Control of Rent & Eviction) Act, 1950 and in the challan for the aforesaid months, initially the rent note was for the months of July, 1980 to December, 1980 but inadvertendly, the same has wrongly been mentioned as "August, 1980 to January, 1981" and this mistake, of mentioning wrong months, has been repeated upto Exhibit-1 and, therefore, the findings of the learned Courts below regarding default in payment of rent giving the eviction decree are not sustainable. The learned counsel prayed for setting aside of the impugned judgments and decrees passed by the learned two Courts concurrently against the defendant-tenant. 6. On the other hand, the learned counsel, Mr. Arvind Samdariya, appearing for the plaintiffs-landlord-respondents urged that the continuous default of the defendant in making the payment of rent over a period of six months for various occasions has been found fatal to the interests of the defendant. However, this was the second default committed by the defendant, as the defendant was given the benefit of first default under Section 13(1)(a) of the Act of 1950 in the earlier suit and, therefore, the present second appeal filed on behalf of the appellant-defendant does not involve any substantial question of law and the same is liable to be dismissed. 7. Having heard the learned counsels for the parties and upon perusal of the record of the case, this Court is satisfied that the present second appeal filed on behalf of the appellant-defendant-tenant against the concurrent findings of fact recorded by the both the Courts below is liable to be dismissed, as the findings are based on relevant and cogent evidence led by the parties before the Courts below.
This is Court is of the opinion that the eviction decree granted in the present case by the Courts below on the ground of continuous default in making the payment of rent by the defendant, has rightly been granted as per the settled legal position in this regard and, therefore, this appeal of the defendant is liable to be dismissed while answering the substantial questions of law in favour of the plaintiffs and against the defendants. 8. Accordingly and in view of the above, the present second appeal filed on behalf of the appellants-LRs of Amrit Lal stands dismissed and the substantial questions of law, framed and quoted herein above, are answered against the defendants and in favour of the plaintiffs. No costs. A copy of this order be sent to the Courts below and to the parties concerned forthwith. 9. In the circumstances of the case, it is directed that the appellant-defendant-tenant shall hand over the peaceful and vacant possession of the suit shop to the respondents-plaintiffs on or before 31.12.2016 and shall pay mesne profit @ Rs.1,000/- per month (Rupees One Thousand only) commencing from the month of December, 2015 and will further continue to pay the mesne profit each month by 15th day of the next succeeding month or in advance to the respondents/plaintiffs also and in case there is any default in payment of mesne profit, the period of One Year for eviction shall stand reduced and the decree of eviction would become executable forthwith. The appellant/defendant/tenant shall also clear all the arrears of rent and mesne profit and pay the same to the respondent/plaintiff within three months from today, otherwise the same will bear interest @9% per annum. The appellant/tenant shall also not sub-let, assign or part with the possession of the suit shop or any part thereof in favour of any one else and would not create any third party interest in the same during the aforesaid period and if it is so done, the same would be treated as void. The appellant-defendant shall furnish a written undertaking incorporating the aforesaid conditions in the trial court within one month and one copy thereof along with affidavit, in this Court.
