JUDGMENT Harsh Kumar, J. Sri Sanjeev Shukla, Special Judge, Anti Corruption (C.B.I.) West, Lucknow is present in person. 2. The Presiding Officer of the Court present in person submitted apology and contended that due to wrong report of office regarding sending of entire record along with bail bonds to Hon'ble High Court with the record of trial court file, order dated 10.8.2015 was wrongly passed; that subsequently on 12.8.2015, F.D.R. presented by applicant has been sent for verification. It is also submitted that since the verification was not received, a reminder was sent on 16.9.2015, upon which the verification report has been received in the office on 19th September, 2015 and since on the date fixed 23.9.2015, nobody appeared on behalf of applicant so no order could be passed and 8th October, 2015 has been fixed, as next date. 3. Considering the apology submitted by the Officer, the facts narrated by him regarding sending the F.D.R. for verification and receipt of verification as well as in view of the undertaking given by the Officer, it is directed that the date fixed be preponed to 28th September, 2015 and reasonable, appropriate order be passed on the application in accordance with procedure laid down by law. It is also made clear that in case, the applicant appears on 26.9.2015, before 28 September, 2015 and applies, the Court will take up the case and pass necessary order as mentioned above. 4. The trial court is further directed to send compliance report by 30.9.2015. 5. Disposed off accordingly. 6. Let a copy of this order be transmitted to court concerned of Special Judge, Anti Corruption (C.B.I.) West, Lucknow by registry.
