JUDGMENT Bharati Sapru, J. Both parties are present. 2. As recorded earlier by this Court there is no doubt that the dispute has arisen between the parties in respect of a contract made between the parties on 26.10.2012. The parties are before this Court and they have agreed that an Arbitrator be appointed. 3. Both parties are agree that Justice S.S. Kulshrestha (retired Judge of this Court) be appointed to act as Arbitrator in the matter. They inform the Court that the consent has already been taken from him. 4. Accordingly, this Court appoints Justice S.S. Kulshrestha (retired Judge of this Court) to act as Arbitrator in the matter. The remuneration of Hon'ble Judge/learned Arbitrator to be fixed between the parties with the consent of learned Arbitrator. The remuneration as well as the expenses to be shared between the parties to the extent of 50% each and half of the remuneration will be given to the learned Arbitrator in advance. 5. Needless to say that the proceedings be commenced at the earliest and in accordance with law. The application is, thus, disposed of.
