ORDER : The petitioner has come forward with this petition seeking for a direction to transfer the investigation in Crime No.34 of 2015 pending on the file of the fourth respondent to any competent police officers. 2. The learned Counsel appearing for the petitioner submitted that the alleged occurrence took place on 24.09.2015 and the complaint has been given, which was taken on file in C.S.R. No. 76 of 2015 and a case has been registered on 25.09.2015 for the offences under Sections 294(b), 325 and 506(i) IPC. He further submits that in the complaint of the page No.1 it was specifically mentioned that the complaint was received on 24.09.2015 at 12.15 hours, whereas in column No.3 of the F.I.R, it was stated as if the complaint was received only on 24.09.2015 at 11.45 hours. Therefore, the respondent police has not investigated the matter in a correct direction. Hence the petitioner is seeking transfer the investigation. 3. Considering the submissions advanced by the learned Counsel appearing for the petitioner and also perusal of the typed set of papers it is seen that the occurrence had taken place on 24.09.2015 at 11.30 a.m., immediately he gave a complaint which was taken on file in C.S.R.No.76 of 2015. In that all the particulars were given after enquiry the case was registered on 25.09.2015 at 11.45.a.m by duly mentioning the name of the accused. Furthermore, in column No.8 it was specifically mentioned that after enquiry the case has been registered. 4. In such circumstances, I do not find any lacuna on the part of the investigating Officer to register the case. Considering the offences under Section 294(b), 323 and 506(i) IPC, I do not find any reasons to interfere with the change of investigation and hence the criminal original petition, being devoid of merits is liable to be dismissed . 5. Accordingly, this Criminal Original Petition is dismissed.
