JUDGMENT Akhtar Husain Khan, J. Heard learned counsel for petitioners as well as learned A.G.A. 2. Present petition has been moved by petitioners, namely, Nitin Mishra and Nizamuddin under Section 482 of Cr.P.C. with prayer to quash proclamation dated 03.06.2015 issued under Section 82 of Cr.P.C. in Crime No.405 of 2014, under Sections 406, 420, 467, 468, 504, 506 IPC, Police Station Kotwali City, District Faizabad. 3. Petitioners are accused named in FIR and they have not surrendered either before police or before Magistrate. Consequently, non bailable warrant was issued against them by Magistrate. Non bailable warrant also could not be executed against them, whereupon, proclamation under Section 82 of Cr.P.C. have been issued against them. Even after proclamation, they have not surrendered. 4. At this stage, learned counsel for the petitioners submitted that petitioners are ready and willing to surrender before Magistrate concerned. In this context, he prayed for only a direction under Section 483 of Cr.P.C. for expeditious disposal of bail application. 5. Learned A.G.A. has no objection to this prayer. 6. A direction for expeditious disposal of bail application appears to be just. 7. In view of above, it is directed that if petitioners appear before Magistrate concerned within one month from today and apply for bail, their bail application shall be disposed of expeditiously by Magistrate concerned in accordance with law. 8. It is further provided that till expiry of one month, process under Section 83 of Cr.P.C. shall not be issued against petitioners in pursuance of proclamation issued under Section 82 of Cr.P.C. 9. Petition moved under Section 482 of Cr.P.C. is disposed of finally.
