JUDGMENT Suneet Kumar, J. Heard learned counsel for the plaintiff/applicant. 2. The plaintiff/applicant has approached this Court assailing the order dated 30 April 2014 passed by the Additional District Judge, Court No. 7, Aligarh in Civil Misc. Appeal No. 41 of 2011 and order dated 19 May 2011 passed by the Civil Judge (Junior Division) Hawali, Aligarh in Original Suit No. 369 of 2008 rejecting the interim injunction application. 3. It is admitted by learned counsel for the applicant that though the defendants are owners of the property by way of registered sale deed, however, would submit that the sale deed was obtained by fraud and misrepresentation. 4. In my opinion, the court below was justified in rejecting the interim injunction application, as injunction could not be granted against the true owner of the property. The plea as to whether the sale deed was obtained by fraud and misrepresentation being a question of fact and law is to be decided in suit. 5. Learned counsel for the applicant would submit that the applicant has filed a fresh injunction application which is pending consideration. 6. This Court is not inclined to interfere with the impugned orders. The petition is, accordingly, dismissed. 7. However, dismissal of this petition shall not preclude the plaintiff/applicant in filing an appropriate urgency application before the concerned court to expedite the injunction application.
