JUDGMENT Heard learned Counsel for the petitioner, learned Standing Counsel for the respondent nos. 1 to 3 and Sri Sharad Tiwari, learned Counsel who has accepted notice on behalf of respondent no. 4. 2. Although recovery proceedings on the basis of recovery certificate have been initiated by the bank and the property mortgaged against the loan obtained by the borrower i.e. petitioner has been attached in furtherence thereof but meanwhile some settlement has been entered into between the bank and borrower for payment of the entire dues within a stiputlated period of time against which a sum of Rs. 900000/- has already been deposited by the petitioner. 3. Since the settlement has been acted upon partially and the bank appears to be willing to accept the balance amount within a further period of three months, we hereby provide that the petitioner may pay the entire dues within a period of three months from today and in the event balance amount is entirely deposited by the petitioner in terms of order passed by this Court as mentioned above, recovery proceedings shall remain in abeyance. The bank shall also furnish a copy of the details of balance account within fifteen days from today. 4. In case the petitioner fails to comply with the direction passed by this Court, the benefit of this order shall not be available to him. 5. With these observations, the writ petition is disposed of.
