JUDGMENT The relief which has been sought in the petition which has been filed in public interest is two fold. The first relief is for taking appropriate steps for the installation of hand pumps at Tehsil Ajeetmal, District Auraiya. The second relief is for initiation of a proper enquiry in respect of funds which were released for the purpose of installation of hand pumps which are allegedly misappropriated by the Nagar Panchayat. The second relief is founded on a report annexed at Annexure-9 which is stated to have been submitted by the Executive Officer of the Nagar Panchayat to the Collector on 18 May 2015. 2. Insofar as the first relief is concerned, we direct the Executive Officer of the Nagar Panchayat to look into the matter and to take a suitable decision in accordance with law preferably within a period of three months of the receipt of a certified copy of this order. 3. Insofar as the second relief is concerned, the allegations in regard to the misappropriation of public funds ought to be looked into by the Collector and District Magistrate, Auraiya. We accordingly permit the petitioners to move the second respondent together with a certified copy of this order so that the issue can be looked into particularly in the light of the report submitted by the Executive officer, so that appropriate steps to secure compliance with law can be pursued expeditiously. 4. The petition is accordingly disposed of. There shall be no order as to costs.
