JUDGMENT Mr. M.M.S. Bedi, J.: - Petitioner seeks the concession of regular bail in a case registered at the instance of complainant Bhag Singh alleging that the petitioner alongwith his two other co-accused Rajinder Singh and Gurdeep Singh earlier known to the complainant had induced the complainant to give money for investment in property with a false promise that huge profits will accrue from the investments in properties around Khanna. The complainant allegedly transferred a sum of Rs.30 lacs to Gurdeep Singh on December 17, 2012 and Rs.1.83 crores in the account of petitioner. The said amount was allegedly not returned to the complainant. Cheques issued to discharge the liability were dishonoured. 2. Learned counsel for the petitioner has submitted that the co-accused of petitioner Gagandeep Singh has been granted the concession of bail on the ground that Rajinder Singh and Gurdeep Singh have been granted the concession of regular bail. 3. Learned Senior Counsel for the complainant Mr. M.L. Saggar had intervened to oppose the petition contending that the undertaking has been given by co-accused Gagandeep Singh to repay the amount whereas the petitioner is not ready to return any amount to the complainant. 4. Learned counsel for the petitioner has urged that the petitioner is suffering from neurological and Cardiac problem and is undergoing treatment at PGI. It has been vehemently argued that the petitioner had not himself misappropriated any money but has transferred the amount to his co-accused. 5. I have heard learned counsel for the petitioner and gone through the police record. A perusal of the record indicates that the main grievance of the complainant is against Ashutosh Negi and Gagandeep Singh who have caused wrongful loss to him. The petitioner claims that he has acted in good faith enabling the complainant to cooperate only the money dealing with Gagandeep Singh and Ashutosh Negi with whom the complainant had business association. 6. Taking into consideration the circumstance that the petitioner has been in custody w.e.f. May 8, 2014 and he is suffering from Cardiac and neurological problems as per the health status report of the petitioner submitted by the Jail Superintendent, he can be granted the concession of bail. 7. Petition is allowed. Petitioner is ordered to be released on bail on his furnishing bail bonds/ surety bonds to the satisfaction of the trial Court. ---------0.B.S.0------------
