JUDGMENT Heard Sri Manoj Kumar Singh, learned counsel for the appellant. 2. The Judgment of the learned Single Judge dated 8.9.2015 is being questioned on the ground that payment of ex-gratia to the dependant of an employee, who died in harness, being a beneficial piece of law should be applied irrespective of the cut off date mentioned therein. 3. The submission in short is to extend the benefit of ex-gratia payment even if the appellant had applied after the cut off date. 4. The learned Single Judge has considered the submissions raised and has come to the conclusion that since the appellant had applied for payment after the cut off date, there would be no occasion to extend any such benefit. 5. So far as the argument of the learned counsel for the petitioner that it should be construed liberally is concerned, it does not appear that any challenge was raised to the virus of the cut off date as such there is no occasion for this Court to bend the Rules or deviate therefrom as the same would amount to violation of Article 14 of the Constitution of India. Consequently, the relief claimed by the appellant cannot be granted. 6. With the aforesaid observations, the appeal is dismissed.
