ORDER The petitioner has come forward with this petition under Section 482 of Code of Criminal Procedure, seeking a direction to the first respondent to transfer the case in Crime No. 608 of 2012 from the file of the second respondent police to any other unbiased investigation officer and investigate the same expeditiously and lay a final report based on the petitioner's representation dated 26.02.2014. 2. It is represented by the learned Government Advocate (criminal side) stating that already the investigation is over and the case has been closed as ' Mistake of Fact' and Referred Charge Sheet has been filed on 22.09.2013. 3. Report has been called for by this Court by order dated 07.10.2015. It is seen from the report that the case has been closed as ' Mistake of Fact', Referred Charge Sheet has been filed and notice has also been issued to the de-facto complainant for filing objection in this regard, if any and now the case is posted on 05.11.2015. 4. Considering the submissions that already final report has been filed as Mistake of fact, notice has been ordered to the de-facto complainant for appearance and posted for filing of objections on 05.11.2014, this criminal original petition is dismissed. However, it is left open to the de-facto complainant to approach before the appropriate forum for the relief.
