JUDGMENT The petitioner invoking the jurisdiction in a public interest litigation states that an order has been passed under Section 133 of the Code of Criminal Procedure, 1973 for the removal of encroachment on a public road on 29 July 2015 by the Sub Divisional Magistrate, Saidpur, District Ghazipur but the order has not been enforced. The jurisdiction of this Court under Article 226 of the Constitution cannot be utilized to execute or enforce orders of the Sub Divisional Magistrate. However, we leave it open to the petitioner to move the competent authority for necessary steps for enforcing the order, if at all the order continues to hold the field. The petition is, accordingly, disposed of. There shall be no order as to costs.
