body2015
JUDGMENT Mr. Jaswant Singh, J.: (Oral) - Respondent nos.4 & 5 i.e. Kishori & Jag Ram sons of Jeevan and Ram Lal filed application dated 22.7.2008 before the Assistant Collector, IInd Grade Jhajjar for correction of Khasra Girdawri in respect of crops Kharif 2006 onwards. 2. The present petitioner filed a suit against Kishori, Jag Ram etc for declaration and permanent injunction on 31.01.2009 which concededly is at the stage of the evidence of the defendants. 3. The Assistant Collector, IInd Grade vide order dated 14.02.2009(P-4) adjourned the correction case of Khasra Girdawries sinea- die till the decision of the civil suit on the application of the present petitioners. The respondents filed appeal and the Collector Jhajjar vide order dated 26.5.2011(P-6) remanded the matter and directed the Assistant Collector, IInd Grade, Jhajjar to decide the correctional case on merits. Appeal of the present petitioners was dismissed by the learned Divisional Commissioner, Rohtak Division vide order dated 31.01.2014 (P-8). The revision filed by the petitioner was also dismissed vide impugned order dated 1.10.2014 (P-9). Hence the present writ petition challenging orders at P-6, P-8, P-9 and seeking restoration of order P-4. 4. After hearing learned Counsel for the petitioners, this Court finds that the reasoning adopted by the learned Collector, Commissioner and Revisional Authority respectively does not suffer from any arbitrariness since concededly till date there is no interim order passed by the Civil Court requiring the stay of proceedings of correction of Khasra Girdawries. It cannot be disputed that it is the duty of the Revenue Officials as per provisions of Punjab Land Revenue Act, 1887 to make entries in Revenue record regarding cultivation of land as per actual tillage and accordingly constantly upgrade their revenue entries. Therefore, the plea of the petitioners seeking stay of proceeding of correction of Khasra Girdawries does not warrant any acceptance. 5. In view of the above, finding no merit in the present writ petition, the same is hereby dismissed. ---------0.B.S.0------------ ———————
