JUDGMENT Krishna Kumar Upadhyaya, petitioner before this Court is assailing the validity of the order dated 12.03.2013 passed by Managing Director U.P. State Warehousing Corporation Lucknow wherein resolve has been taken for undertaking disciplinary proceeding against the petitioner. 2. On the matter being taken up today, from the side of petitioner, it has been sought to be contended that once petitioner has already attained the age of superannuation on 31.07.2010, then Managing Director U.P. State Warehousing Corporation Lucknow has got no authority to initiate any disciplinary proceeding as against the petitioner for the reason that under the U.P. State Warehousing Corporation Staff Regulation, there is no such authority conferred upon the authority concern to undertake disciplinary proceeding against the employee after retirement akin to Regulation 351-A of Civil Service Regulation, as such order passed by Managing Director U.P. State Warehousing Corporation Lucknow is void and cannot be subscribed by law. 3. Sri Mohit Singh, who has entered appearance on behalf of Corporation has conceded to this legal situation. 4. Once such is the factual situation that has so emerged and petitioner has already retired on 31.07.2010 and there is no provision under U.P. State Warehousing Corporation Staff Regulation to initiate disciplinary proceeding then action so taken against the petitioner that is impugned in the present case, in all eventuality cannot be subscribed. 5. This Court in identical circumstances, in Civil Misc. Writ Petition No. 33886 of 2015, has not approved of the action taken by U.P. State Warehousing Corporation, as such in the present case also, action taken by the Corporation is not all approved of and the order dated 12.03.2013 in so far as it relates to petitioner is hereby quashed and set aside. Consequently, present writ petition is allowed.
