JUDGMENT Saleem and four others are before this Court, assailing the validity of the notice dated 07.09.2015 published in newspaper "Amar Ujala" by the President, Nagar Palika Parishad, Dadri, District Gautam Budh Nagar asking incumbents who are in illegal possession of the premises to vacate the same till 13.09.2015, otherwise they shall be forcibly evicted from the spot. 2. Learned Counsel for the petitioners is contending before this Court they are Bhumidhar of the land in question and in view of this such, such notice ought not to have been given. 3. Claim of the petitioners has already been directed by this Court to be agitated before the Competent Court and categorical mention has been made in the order dated 18.08.2015 that Consolidation Court has no right to adjudicate the title over the abadi land. Not only this, earlier civil misc. writ petition has been filed bearing Civil Misc. Writ Petition No 57276 of 2013 and this Court at the said point of time on 11.10.2013 has proceeded to ask the District Magistrate to take appropriate decision in the matter and pursuant thereto District Magistrate on 25.06.2015 has proceeded to pass order clearly and categorically mentioning therein that in reference of ownership in question, petitioners have miserably failed to substantiate their right and they should get their right decided by the Consolidation Court as per order dated 18.08.2015, such rights are not at all to be adjudicated by the Consolidation Court, but it has been categorically mentioned therein that petitioners have to get their right decided by the competent Court. 4. Once all sort of disputed question of facts are being raised by the petitioners claiming that they are Bhumidhar of the land in dispute, then as far as this Court is concern, this Court cannot come to the rescue and reprieve of the petitioners, as observed by this Court on 18.08.2015, petitioners should approach the competent Court for adjudicating of their right. 5. Consequently, present writ petition is dismissed.
