JUDGMENT The reliefs which the petitioner seeks, invoking the jurisdiction in a PIL are in the following terms: "i) issue a writ, order or direction in the nature of mandamus commanding the respondent no.2 to 4 to dispossess the respondent no.6 to 11 from Gata No. 3689 area 0.3280 Hectare (1 Bigha 8 Biswa) and Gata No.3691 area 0.2140 Hectare (16 Biswa 7 Dhoor) is a Gram Sabha land recorded as pond (Sathoo Pond) in revenue record in the Fasli Year 1287 of Village-Ghisuwa Khas, Pargana- Ghisuwa, Tehsil- Machhali Shahar, District Jaunpur. ii) issue a writ, order or direction in the nature of mandamus commanding the respondent no.2 to 4 to remove the encroachment of respondent no.6 to 11 from the public utility land of Gram Sabha recorded as pond of Village- Ghisuwa Khas, Pargana- Ghisuwa, Tehsil- Machhali Shahar, District- Jaunpur." 2. The revenue record which is annexed to the writ petition at Annexure-2 in fact indicates that the names of private respondents have been mutated in the record. Hence, unless steps are taken for correction of the revenue record in accordance with the provisions of Sections 33 and 39 of the U.P. Land Revenue Act, 1901, no relief can be granted at this stage in the PIL. We leave it open to the concerned persons to take recourse to the remedies as available in law under the U.P. Land Revenue Act, 1901. 3. The petition is, accordingly, dismissed. There shall be no order as to costs.
