Judgment 1. The petitioner seeks for a Writ of Mandamus to consider the representation dated 17.12.2014 seeking for promotion to the post of Headmaster in the Government Higher Secondary School under Section 33 of Persons with Disabilities (Equal Opportunities Protection of Rights and Full Participation) Act 1995. (for short 'the Act'). 2. The petitioner joined as P.G.Assistant Teacher in Government Higher Secondary School, Vedaraniam, Nagapattinam District. It is stated that the petitioner being a disabled person with 70% entitled to get promotion as Headmaster as per Section 32 and 33 of the said Act. He is also having necessary qualification to be promoted as Headmaster. 3. It is seen that the petitioner made a representation on 17.12.2014 seeking for benefit of such reservation under the above said Act for promotion to the post of Headmaster. Therefore, it is for the second respondent to consider the said representation and pass appropriate orders on the same on merits and in accordance with law. 4. Accordingly, this Writ Petition is disposed of, without expressing any view on the merits and contentions raised by the petitioner, only with a direction to the second respondent to consider the representation of the petitioner dated 17.12.2014 and pass appropriate orders on merits and in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order. With the above direction, this Writ Petition stands disposed of. No costs.
