JUDGMENT Heard learned counsel for the petitioner and the learned Standing Counsel who has accepted notices for the respondents. 2. The petitioner while working on the post of Medical Officer (Ayurved) has superannuated on 31.1.2013. The contention of the learned counsel for the petitioner is that all service benefits in terms of seniority and pension have been granted to him after completing his service from the relevant date. However the benefit of selection grade in the light of the Government Order dated 12th May, 1993 and the benefit of financial up-gradation in the revised pay scale w.e.f. 4th July, 2002 yet remains to be redressed. 3. The further contention of the petitioner is that similarly situate persons have already been given such benefits and therefore the petitioner cannot be discriminated as per the averments contained in Para 9 of the petition. 4. From the pleadings on record, we find that an order dated 25.6.2010 which is in relation to similarly situate persons have been granted benefits therefore there may be no reasonable justification for denying similar benefit to the petitioner. 5. It is left open to the petitioner to make a representation about the grievance raised in the present petition and in case any such representation is made within a period of one month from today, the same shall be considered by the competent authority by passing a reasoned and speaking order within three months thereafter in the light of the contentions raised and having regard to the order passed by this court. 6. The writ petition stands disposed off with the said observations.
