JUDGMENT Abhinava Upadhya, J. Heard learned counsel for the petitioner and the learned Standing Counsel appearing for the State-respondents. 2. By means of this writ petition the petitioner has come up to this Court against the proceedings being initiated under Section 34 of U.P.Land Revenue Act, 1901 for expunging the name of the petitioner at the behest of a person, who claims that the same property was mortgaged to him. Such application was rejected against which appeal was filed and in appeal the matter has been remanded for re-consideration after hearing the respondents. 3. In my view, since the matter has been remanded, it would be open for both the parties to put forward their claim. As such, at this stage, I am not inclined to interfere. 4. Learned counsel for the petitioner then submits that the proceedings pending before the respondent no.3 be directed to be concluded expeditiously. 5. The writ petition is disposed of with the observation that the respondent no.3 may proceed with the matter, which has been sent after remand and consider the objection etc. filed by the petitioner and decide the claim in accordance with law without allowing unnecessary adjournment to either of the parties provided there is no other legal impediment in the same, inasmuch as, no interim order is operating against the disposal of the said case.
