JUDGMENT : 1. Applications have been invited by Child Development Project Officer, Rajwar from the female eligible candidates for the engagement as Anganwadi Workers and Anganwadi Helpers in ICDS Project Rajwar, one for Tantry Mohalla Khanbal of Village Handwara and another for Anganwadi Centre Hangdar Mohalla Palpora. Petitioner and respondent No. 5 have competed for the post of Anganwadi Worker, Anganwadi Centre Hangdar of Village Palpora. 2. Respondent No. 5 on the basis of the merit has been tentatively selected. As against the tentative selection, petitioner has filed the objection and at the same time has filed the instant petition projecting that the petitioner is superior in merit as having secured 217 marks out of 500 marks in the matriculation whereas respondent No. 5 has secured 178 marks out of 500 marks. 3. The reply filed by the respondent No. 1 to 4 is suggestive of the fact that the petitioner in fact is resident of Village Warpora where Anganwadi Centre is functional that too in the residential house of the petitioner where her mother is working as Anganwadi Helper. Subsequently, vide 3rd phase expansion Programme, another Anganwadi Centre has been sanctioned for uncovered Hamlet/Mohalla (Hangdhar Mohalla) of Revenue Village Warpora for which petitioner has also applied and has been admitted to interview but she got only (3) three marks whereas respondent No. 5 got (10) ten marks, so on overall assessment of merit, respondent No. 5 was tentatively selected. 4. While responding to the first contention that the petitioner belongs to the War Mohalla were Anganwadi Centre is already functional and the mother of the petitioner is working as Anganwadi Helper, learned counsel would submit that the petitioner is married to a boy who is resident of Hangdar Mohalla, as such, she is eligible. Now this issue pales into insignificance because the petitioner has been admittedto interview. She could only secure three marks in the interview as compared to the respondent No. 5 who secured 10 marks. So on overall merit, respondent No. 5 has been tentatively selected. 5. Learned counsel for the petitioner would submit that award of marks in the viva should have been proportionate not disproportionate to the marks obtained in the academics i.e. at the Matric level but said contention is totally irrelevant and unacceptable.

Award of marks in interview depends upon the performance of the candidates and then the subjective satisfaction of the Selection Committee which position cannot be interfered with by the Court unless and until some mala fidesare attributed, nothing in that direction has been projected in the instant petition. 6. Unnecessarily, process of selection has been stalled. In view of the clear stand of the respondents and the clarity of the position of the merit, this petition only merits dismissal, therefore, is dismissed. Respondent authorities shall finalize the process of selection as initiated with promptitude. Disposed of as above.
