JUDGMENT The appellant had filed a writ petition1 seeking appointment on the post of assistant clerk. The extract of the relief which was sought in the earlier writ petition which has been annexed to the affidavit of the appellant in the special appeal is as follows: "(a) Issue writ direction or orders in the nature of mandamus commanding the respondent authorities to issue appointment letter to the petitioner for the post of Assistant Clerk as in the identical and similar case, appointment letter has been issued to one Arvind Kumar son Sri Anant Ram on 2.6.1997 and since there he is working in the department." 2. The writ petition was unconditionally dismissed as withdrawn in terms of the request made by the appellant before a learned Single Judge when the following order was passed on 23 August 2010: "Shri R.M. Saggi, learned counsel for the petitioner at the outset stated that the petition may be dismissed as withdrawn. Learned Standing Counsel for the respondents has no objection to this request. The writ petition is accordingly, dismissed as withdrawn. Interim order, if any, shall stands vacated." 3. The appellant filed a second writ petition initially seeking a decision on his representation but has amended the writ petition thereafter to challenge an order passed by the District Basic Education Officer while seeking a direction for his appointment on the post of assistant clerk. 4. The writ petition has been dismissed by the learned Single on 5 November 2015. The appellant, as the record indicates, had sought to establish his claim for appointment as assistant clerk in a writ petition of 2010 which was dismissed as withdrawn on 23 August 2010. Once the earlier writ petition was unconditionally dismissed as withdrawn, the second writ petition was misconceived and was clearly not maintainable. 5. Hence, we see no reason to entertain the special appeal. 6. The special appeal is, therefore, dismissed. There shall be no order as to costs.
