JUDGMENT At the hearing of the writ petition, which is filed to challenge a recovery citation for the non payment of the dues of the Bank, the only point which has been pressed is that reasonable installments may be granted to the petitioner to clear the outstanding dues. 2. Mr.Prashant Kumar Srivastava, the learned counsel appearing for the third respondent has no objection. 3. Accordingly, on the terms as agreed before the Court, we pass the following order: (1) The petitioner shall deposit an amount representing 25% of the entire outstandings up to date inclusive of interest on or before 1 January 2016; (2) The rest of the amount shall be deposited in equal monthly installments and in such a manner that the entire payment would be made within a period of six months i.e. by 30 June 2016; (3) In the event that the petitioner complies with the time schedule which has been agreed upon, no steps shall be taken for adopting coercive proceedings for enforcement of the recovery citation. However, in the event of any single default, the authorities would be at liberty to take action in accordance with law. 4. The petition is accordingly disposed of. There shall be no order as to costs.
