JUDGMENT Dr. Arvind Kumar Sharma is before this Court with the request to issue writ in the nature of mandamus commanding the respondent no. 2 i.e. the Secretary, U.P. Public Service Commission Allahabad to allow the petitioner for appearing in the interview on the post of Lecturer (PMR) that was scheduled to take place on 21.12.2015. 2. The entire arguments of the petitioner has been based on the foundation and basis that one Dr. Yash Veer Singh Gond, who was similarly situated, has been called for interview and petitioner has been left out. 3. On the matter being taken up today, on the basis of instructions, so received by the U.P. Public Service Commission, it has been informed by Sri F.A. Ansari, Advocate, that as far as Dr. Yash Veer Singh Gond is concerned, he has been called for interview but as he was not at all fulfilling the requisite minimum eligibility criteria, his candidature has been dropped by the Commission and only one candidate has been recommended for being offered appointment as against two existed posts in question. 4. Once such is the factual situation that entire claim of petitioner is based on the claim of Dr. Yash Veer Singh Gond and as per the instructions, so received, candidature of Dr. Yash Veer Singh Gond has already been non-suited, then as on date when petitioner does not has to his credit the requisite minimum eligibility criteria on or before 17.3.2015, no relief or reprieve can be given to him by this Court. Writ petition sans merit and same is dismissed, accordingly.
