JUDGMENT Suneet Kumar, J. The U.P. State Industrial Development Corporation Ltd. has approached this Court assailing the order 17 December 2015 passed in Execution Case No. 18 of 2012, Chandrika Versus Collector and others, whereby, non-bailable warrant has been issued against the officials of the applicant in execution proceedings. 2. Submission of learned counsel for the applicant is that already a First Appeal has been preferred against the judgment and decree of the reference court passed in land acquisition proceedings, however, no order has been passed on the injunction application, but, it is sought to be urged that the execution proceedings be kept in abeyance pending decision on the injunction application, the applicants undertake to deposit the decretal sum. 3. Be that as it may, without entering into the merits of the case, it is provided that the applicant shall deposit the entire decretal amount before the court below within a period of three months from today. 4. Till then, no coercive action shall be taken against the applicant pursuant to the order dated 17 December 2015. It is made clear that in the event of default, the petition shall stand dismissed without reference to the Court. With the aforesaid observation/directions, the petition is disposed of finally.
