JUDGMENT 1. - This criminal bail application has been filed under Section 439 Cr.P.C. on behalf of the petitioner. The petitioner has been arrested in connection with the allegations levelled in the FIR No. 48/2014 registered at Police Station, Chopasni Housing Board, District Jodhpur for the offences punishable under Sections 170, 171, 167, 168, 419, 420, 465, 468 and 120-B IPC. 2. Learned counsel for the petitioner has submitted that the allegation against the petitioner is to the effect that he had introduced the complainant to Ashok Saxena, and later on took money from the complainant while assuring him to give him a job in the Indian Railways. Learned counsel for the petitioner has submitted that the accused - Ashok Saxena has already been granted bail by this court on 07.07.2014. It is also contended that the charge-sheet has already been filed against the petitioner and, therefore, there is no requirement of the petitioner for custodial interrogation. Learned counsel for the petitioner has, therefore, prayed that the petitioner may be released on bail. 3. Learned Public Prosecutor has opposed the bail application. 4. Heard learned counsel for the petitioner as well as learned Public Prosecutor and also perused the material on record. 5. Having regard to the totality of the facts and circumstances of the case, without expressing any opinion on the merits of the case, I deem it just and proper to grant bail to the accused petitioner under Section 439 Cr.P.C. 6. Accordingly, this bail application filed under Section 439 Cr.P.C. is allowed and it is directed that petition-Manohar Bharti S/o Shanker Bharti shall be released on bail in connection with FIR No. 48/2014 of Police Station, Chopasni Housing Board, District Jodhpur provided he executes a personal bond in a sum of Rs. 1,00,000/- with two sound and solvent sureties of Rs. 50,000/- each to the satisfaction of learned trial court for his appearance before that court on each and every date of hearing and whenever called upon to do so till the completion of the trial.Bail application allowed. *******
