JUDGMENT : Hon’ble Sudhanshu Dhulia, J. (Oral) 1. Mr. Jitendra Chaudhary, Advocate, present for the applicants. 2. Ms. Mamta Joshi, learned Brief Holder, present for the State/respondent no. 1. 3. An F.I.R. was lodged by the respondent no. 2 against the applicants for the offence under Sections 353/332/323/504 of I.P.C. at Police Station ROP Kashipur District Udham Singh Nagar. After investigation, charge-sheet has been filed by the police. Consequently the learned Magistrate took cognizance and issued summons to the present applicants. Hence, this application under Section 482 CrPC before this Court. 4. Meanwhile, applicant nos. 2 and 3 were arrested and are presently on bail. Applicant no. 1 being a woman has not been arrested so far. Earlier in a Writ Petition (WPCRL) No. 466 of 2014, an interim protection was granted by this Court to the applicant no. 1 under Sections 353/332/323/504 of IPC, since the charge-sheet has been filed by the police in the matter and considering the fact that the applicants are not hardened criminals and facing charges against the offences which carry punishment upto three years. 5. Applicant no. 1 would be at liberty to move an application for her bail before the court concerned, which may be considered, as far as possible, on the same day itself. In case for any reason, the bail is deferred, the court below may consider granting interim bail to the applicant no. 1, keeping in mind that the applicant no. 1 is a woman. In case, it is rejected, then the learned Magistrate shall forward the papers on the same day before the Sessions Judge who shall consider the bail on the same day itself on the same terms as directed to the learned Magistrate. 6. Regarding the other applicants, it is made clear that they shall also appear before the court below and move application inter alia for their discharge, if they are so advised which shall be considered in accordance with law. 7. The application under Section 482 CrPC is hereby dismissed. 8. Interim order, if any, stands vacated.
