JUDGMENT : Hon’ble Sudhanshu Dhulia, J. (Oral) 1. Mr. Shailendra Nauriyal, Advocate, for the petitioner. 2. Mr. P.S. Saun, learned Deputy Advocate General, with Mr. H.S. Rawal, learned A.G.A, present for the State/respondent no. 1. 3. Short counter affidavit filed today in the Court on behalf of respondent no. 2 is taken on record. 4. The present petitioner is in jail since he has been arrested consequent to the lodging of the first information report by respondent no. 2 under Sections 420/467/468/471/504/506 of IPC at Reporting Police Chowki Naya Gaon, Police Station Patel Nagar, Dehradun. 5. It appears that the petitioner had given some kind of promise to the complainant that he will sell a piece of land and for that an advance of Rs.5,00,000/- (Rupees Five Lakhs Only) has been taken by him. The deal never materialized. Consequently, complainant filed the first information report against the petitioner. The petitioner was arrested on 27.08.2015. Meanwhile, a statement has been given by the learned counsel for the respondent no. 2 Mr. Jayvardhan Kandpal that the entire money of Rs.5,50,000/- (Rupees Five Lakhs Fifty Thousand Only) has been received by him. 6. In case, the petitioner moves an application for his bail, the same shall be considered, as far as possible, on the same day itself by the court below in accordance with law. While considering the bail application of the present petitioner, the alleged nature of offence and the fact now the entire money has been given by the petitioner to the respondent no. 2 which is admitted by the counsel for the respondent no. 2 shall be considered by the court below and the fact that inter alia, it is a private nature of offence. 7. In view of the above, the writ petition stands disposed.
