JUDGMENT : I.A. 13/2014 in Writ Petition (C) No. 463/ 2012 1. Mr. Prashant Bhushan, learned counsel has handed over a short note on behalf of the petitioners. 2. Mr. A. Sharan, learned senior counsel would like to look into the aforesaid note. 3. The application be listed alongwith the Secret Notes on IA filed by the CBI on 8th May, 2014 and 18th September, 2014 on 16th February, 2015 at 2.00 p.m. CrI. MP No. 387/2015 in Writ Petition (C) No. 463/2012 4. List the CrI.MP on 16th February, 2015 at 2.00 p.m. Writ Petition (Crl.) No. 120 of 2012 and Writ Petition (C) No. 463/2012 5. We have perused the sealed report filed by the Central Vigilance Commission on 29.12.2014. 6. The report be taken on record. 7. On 8th December, 2014, we had issued a direction that the Chief Secretary of the Government of Gujarat shall cooperate with the CBI in the investigations, but we are told by Mr. Sharan that in spite of our order and various requests having been made by the CBI, there is no response from the State of Gujarat and the documents have not been handed over. 8. Issue notice to the Chief Secretary of the State of Gujarat to explain as to why cooperation is not being extended to the CBI in the investigations. 9. Notice is returnable on 9th February, 2015.
