ORDER : A. Ramalingeswara Rao, J. 1. Heard learned Counsel. This writ petition was filed, challenging the action of respondents 2 and 3 in issuing fresh tender notification on 24.2.2015 cancelling the tender notification dated 16.1.2015 for the work of restoration of Darbar Hall Building, University College for Women, Koti, Hyderabad. 2. The tender notice was initially issued on 16.1.2015 with the estimated value of Rs. 1,55,43,082/- and the period of execution was 18 months. The last date for submission of tender was 3.2.2015 and that the tender would be considered in two stages viz., technical bid and financial bid. The last date for opening the technical bid was dated 4.2.2015 and for financial bid was dated 9.2.2015. 3. It is the case of the petitioner that, though he was qualified and satisfied all the conditions of eligibility, the technical bid only was opened on 4.2.2015 but the financial bid was not opened on 9.2.2015 and that no communication was issued to the petitioner with regard to the reasons for not opening the financial bid. The petitioner submitted a representation to the 2nd respondent on 11.2.2015. Instead of giving reply, a fresh notification was issued on 24.2.2015. Challenging the same, the petitioner filed the present writ petition. 4. The petitioner himself filed a print out from the computer dated 24.2.2015 addressed to the petitioner through e-mail stating that the Project Implementation Committee in its meeting held on 9.2.2015 had expressed that since both the tenderers did not fulfill; the required qualification, it was decided to go for re-tenders. 5. This Court, initially while issuing notice to the respondents on 9.3.2015, held that the tenders shall not be finalized for a period of three weeks. Thereafter, the respondents filed counter-affidavit enclosing a copy of the minutes of the meeting of Project Implementation Committee dated 9.2.2015, wherein the following decision was taken: "The members of the Project Implementation Committee (PIC) deliberated on the technical aspects of the bids received for the Restoration Works of Durbar Hall (Residency) at University College for Women, Koti based on the bid document uploaded, by namely Party 1 D. Ravinder and Party 2 M/s. Jeemodhar Conservators Pvt. Ltd. After due discussions and close examination as well as interviews with both the parties, it has been resolved, to go for re-tendering as both the party's failed to meet the tender conditions." 6.
In view of the decision taken at that meeting, this Court is satisfied with regard to the cancellation of tender notification dated 16.1.2015 and feels that it is not necessary for this Court to go into other aspects of the matter relating to the eligibility of the 4th respondent, as the petitioner as well as the 4th respondent were initially disqualified and were found to be not fulfilling the conditions pursuant to the first notification dated 16.1.2015. Now a second tender notification is issued on 24.2.2015. 7. However, learned Counsel for the petitioner submits that though the 4th respondent was not qualified, the work is going to be awarded to the 4th respondent pursuant to the tender notification dated 24.2.2015. This Court feels that it is not the subject-matter within the purview of consideration in this writ petition and it is open to the petitioner to take necessary steps in accordance with law, as and when the work is awarded to the 4th respondent. 8. The writ petition is accordingly dismissed. There shall be no order as to costs. Pending miscellaneous petitions in this writ petition, if any, shall stand closed in consequence.
