body2015
Judgment 1. Mr.S.Kumar, learned Additional Government Pleader takes notice for the respondent and by consent of both the parties, the main writ petition itself is taken up for final disposal at the stage of admission. 2. Heard the learned Counsel appearing for the petitioner and the learned Additional Government Pleader appearing for the respondent. 3. In this writ petition, the petitioner is seeking for a Writ of Mandamus directing the respondent to permit him to quarry rough stone in Survey No.568 of Pavthiram Village, Aravakurichi Taluk, Karur District till 16.05.2017. 4. The grievance of the petitioner is that, even though he was granted quarry lease for a period ending up to 04.05.2015, he could not do the quarrying operation as there was an encroachment in the site, resulting in filing a writ petition by the petitioner before this Court for removal of such encroachment and in that process there was a delay in commencing the quary operation. Therefore, it is contended by the petitioner, the lease period has to be extended by another two years. 5. Whether the petitioner is entitled to such extension of lease period or not is for the respondent to consider and decide and this Court is not expressing any view at this point of time. Further, the petitioner has already made a representation to the respondent on 31.12.2014. Therefore, this Court only directs the respondent to consider the representation of the petitioner dated 31.12.2014, and pass orders on the same and on merits and in accordance with law within a period of four weeks from the date of receipt of a copy of this order. Accordingly, this writ petition is disposed of. Consequently, the connected Miscellaneous petition is closed. No costs.
