Judgment 1. The Writ Petition has been filed seeking for a Mandamus directing the first and the second respondents to give necessary police protection to the petitioner, other candidates and voters for participating in the election for the office bearers of the fourth respondent Sabha, to be held on 01.02.2015 at S.S.K.Vijayalakshmi Mahal, Nagal Nagar, Dindigul. 2. According to the petitioner, a newly Elected Committee of the Sabha is going to be held on 01.02.2015. The petitioner is also one of the aspirants for the post of President ship. In this connection, a notification was issued for the proposed election on 01.02.2015. He got intimation regarding the election in question only on 26.01.2015 and immediately, on 27.01.2015, he sent a representation seeking police protection to the authorities concerned. When he approached the authorities to file his nomination, he was threatened by the sixth respondent and their henchmen. Therefore, he apprehends danger that he or any other members, if they participate in the election, they may be threatened by the sixth respondent and his agents. Further, he would contend that a large number of people is going to be participated for electing the President and unless police protection is given, there is likelihood of chaos and confusion that would arise in the election. Therefore, the present Writ Petition. 3. The learned Special Government Pleader on instructions would submit that that the representation itself has not reached the respondent police, as it has been posted only on 27.01.2015, late in the night at 11.15 p.m. by RMS. It is likely to reach only today. i.e. on 30.01.2015. Therefore, the Writ Petition is a pre-mature one. 4. In view of the exigencies and urgency involved in the meeting to be held on 01.02.2015 and also in view of the apprehension of the petitioner, this Court only directs the second respondent to consider the representation of the petitioner dated 27.01.2015, after giving an opportunity to the petitioner and the sixth respondent and other interested parties, if any and pass appropriate orders granting police protection for the election of the petitioner Sabha. The learned counsel appearing for the petitioner agreed to pay the costs which the respondent police may likely to incur for the police protection.
The learned counsel appearing for the petitioner agreed to pay the costs which the respondent police may likely to incur for the police protection. As the time is very short, the petitioner is permitted to approach the respondent police in person tomorrow along with a copy of this order to seek necessary police protection for the election and to enable the respondent police to expedite the process involved in it. 5. With the above direction, this Writ Petition is disposed of. Consequently, the connected miscellaneous petition is closed. No costs.
