The appellant/plaintiff, Gattu Devi @ Laxmi Devi, having lost before the two courts below, has preferred the present second appeal under Section 100 of the Code of Civil Procedure, 1908, assailing the impugned judgment and decree dated 08.04.2005 passed by learned Additional District Judge No.1, Udaipur, dismissing plaintiff's Appeal No.35/2004-Gattu Devi @ Laxmi Devi v. Pyarelal, and upholding the judgment and decree dated 23.03.2000 passed by learned Civil Judge (Sr. Division), Vallabhnagar, District: Udaipur, in Civil Original Suit No.48/1997- Gattu Devi @ Laxmi Devi v. Pyarelal, whereby the suit filed by the appellant/plaintiff against the respondent/defendant for possession and permanent with respect to disputed property situated in front of Satyanarayanji Temple, was dismissed and the counter claim filed by the respondent/defendant, Pyarelal with respect to suit property was allowed. 2. The first appeal filed by the appellants/plaintiffs was also dismissed by the learned Additional District Judge No.1, Udaipur, vide judgment and decree dated 08.04.2005. Mr. Ravi Bhansali and Mr. Dhanesh Saraswat, learned counsel for the appellant/plaintiff submits that the learned courts below have erred in rejecting plaintiff's suit and in allowing the defendant's counter claim. They further submitted that the although the courts below have accepted the execution of the Will dated 23.05.1991 by late Sh. Ambalal, however, the courts below have erred in refusing to grant decree as prayed for. Therefore, the findings of the court below while not granting any relief to the plaintiff is absolutely unjust, improper and the same deserve to be quashed and set aside. 5. On the other hand, Mr. Mridul Jain, learned counsel for the respondent/defendant, supported the impugned judgments and decrees of the courts below and submitted that no substantial question of law arises in the present second appeal. He further submitted that the plaintiff despite the opportunity available to her did not appear before the trial court to lead evidence and the learned courts below considering the material placed before them evaluated the same and rightly proceeded to reject the suit filed by the appellant/plaintiff. 6. Having heard the learned counsel for the parties, and upon perusal of the judgments and decree of the two courts below, this Court is of the opinion that no substantial question of law arises in the present second appeal of the appellant/plaintiff under Section 100 of the Code of Civil Procedure, 1908, and the present second appeal deserves dismissal. Both the courts below after discussing the relevant evidence led by the parties have rightly and concurrently dismissed the suit filed by the appellants/plaintiffs for permanent injunction and mandatory injunction against the respondents/defendants. This Will was to operate in favour of beneficiary i.e. the son who served the executor of the Will. These are findings of facts that defendant was entitled to get the willed property on account of his living with Ambalal in his later years and serving him. Thus he will get the property and not the plaintiff, who did not even appear in the witness box before the learned trial court. This Court does not find any ground to upset the judgments and decree passed by the two courts below. 7. Resultantly, the present second appeal filed by the appellants/plaintiffs assailing the concurrent judgment and decree of the courts below dismissing the suit filed by the plaintiff/appellant is dismissed.
