JUDGMENT 1. - The present second ball application has been filed under Section 439 Cr.P.C. The petitioners have been arrested in connection with FIR No. 14/2014, Police Station Sojat Road, district Pall for the offences under Sections 420, 406, 409, 120-B, 467 and 471 IPC. 2. This is second bail application. When the first bail application was dismissed, the matter was still under .Investigation. As per the Investigation report, the present two petitioners were labours working with the main accused Parasmal. As such, Parasmal exploited the present petitioners to obtain the loan In their names and it was Parasmal who approached the goldsmith for making the substandard gold ornaments. The statement of the goldsmith has also been recorded. He too has stated that it was Parasmal who approached him for making substandard gold ornaments. The role of the present petitioners is totally different from the other co-accused. 3. In view of the above, this Court deems it just and proper to enlarge the accused petitioners on ball. 4. Accordingly, the present second bail application under Section 439 Cr.P.C. is allowed and it is ordered that the accused-petitioner (1) Dhanna Ram s/o Gopi Ram and (2) Kailash Chandra s/o Kana Ram shall be enlarged on ball provided they furnish a personal bond in the sum of Rs. 50,000/- with two sureties of Rs. 25,000/- each to the satisfaction of the learned trial Judge for their her appearance before the court concerned on all the dates of hearing as and when called upon to do so. 5. However, nothing said herein will have any bearing on the merits of the case.Second bail applications allowed. *******
